Jury Rules Against Mongols

Late this morning, a jury in Orange County, California voted to repeal the First Amendment and strip the Mongols Motorcycle Club and various other identifiers of membership including the club’s name.

The jury verdict also repudiated the frequently cited arguments that all crime is personal and that there is no guilt by association. There have been exceptions to these comforting, common law platitudes before. The most obvious is the internment of 110,000 Japanese Americans in February 1942.

The Mongols club has continuously used the “collective membership marks” since 1969.

Very, Very Bad Club

Assistant United States Attorney Steven R. Welk, who is the Chief of the Asset Forfeiture Section of the United States District Court for the Central District of California, said this week that the government intends to seize not simply the patches Mongols wear on their vests but also shirts, rings, belts, belt buckles, helmets, bandanas, stickers, cigarette lighters, mouse pads, pins, bottle openers, kitchen magnets, coffee mugs and motorcycle parts that are decorated with Mongols symbols.

Welk said sales of the personal items provided the motorcycle club with “a lot of money.”

Without discussing the Bill of Rights, Welk assured the jury this week that “this court can take the marks” and “all items of personal property that include the marks.” He convinced the jury that taking the Mongols symbols is “the only way to stop the endless cycle of crime this organization encourages.”
He called Mongols members “urban predators” who are “empowered by these symbols that they wear like armor.” He said “the marks are part of a steady ongoing flow that keeps the (Mongols) organization going.”

“The power of these symbols,” Welk said, “goes well beyond the effect they have on the men who wear them.”

Generally, federal judges order forfeiture to begin immediately after a jury authorizes it but Judge David O. Carter said today that he will not consider issuing an order of forfeiture until sometime after a hearing on February 28.

Late yesterday afternoon, Mongols attorney Joseph Yanny filed a motion to overturn the verdict that found a hypothetical affinity entity called Mongol Nation guilty of racketeering. Prosecutors have asked for time to respond to Yanny’s 35-page motion. Before implementing the forfeiture, Carter also intends to hear arguments on the constitutionality of the forfeiture. All that will be debated at the February hearing.

If Carter does enter a forfeiture order, it would be the second time a district judge has authorized the confiscation of Mongols symbols. The first time, ten years ago, police carried out numerous raids on Mongols events and private homes to confiscate Mongols symbols.

Government Says

A government press release issued shortly after the jury returned its verdict said:

“Today’s verdict – which will result in the forfeiture of the Mongol’s legal interests in the word “Mongols,” the gang’s center patch that depicts a goateed motorcycle rider, and combination of the two patches often seen on the Mongols’ leather vests – is the first of its kind in the nation. The verdict also ordered the forfeiture of scores of items bearing the Mongols name and logo that were seized during a lengthy investigation into the gang. During closing arguments earlier this week, prosecutors said members of the Mongols were “empowered by these symbols that they wear like armor.”

“Pursuant to federal criminal forfeiture law, the verdict requires the entry of a “preliminary order of forfeiture” as part of the sentencing on the Mongols’ RICO convictions, according to documents filed by prosecutors. With further litigation expected on the forfeiture of the name and logo, prosecutors at this time have not asked the court for an order that would permit authorities to seize additional items bearing the name and logo from individual members of the gang.

“‘The Mongols are a notorious criminal organization whose members regularly engage in violent acts against law enforcement officers, rival gangs and members of the public,’ said United States Attorney Nick Hanna. ‘The verdicts in this case brand the Mongols as a racketeering enterprise and direct the forfeiture of property used by the gang for decades to encourage and reward numerous acts of murder, assault and drug trafficking. The prosecution of an organization built around crime realizes one of the most important goals of the RICO Act – the eradication of organized crime by providing enhanced sanctions, including forfeiture, that attack the sources of a criminal enterprise’s economic power and influence.’

“‘ATF spent decades infiltrating and working to shut down this criminal organization which engages in heinous violent acts,’ said Bill McMullan, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives, Los Angeles Field Division. ‘We are proud our work resulted in their unity symbol, the Mongol patch, being forfeited.’”

“United States District Judge David O. Carter, who oversaw the trial of the RICO case against the Mongols gang, will schedule a hearing to impose the sentence on the organization. In addition to the forfeiture, the Mongols may be subject to monetary fines.”

    Carter may NOT, issue a judicial forfeiture order. It remains to be seen whether he will or not.

    2) Verdict, is subject to appeal.

    3) Bill Of Rights, was NOT written with an expiration date, and neither was the
    main body of the Constitution.

    4) Article 3, U.S. Consti.(1787) CREATED every federal court in the nation in the
    first instance, therefore if the “Constitution does not exist” as some say,
    NEITHER do the fucking U.S. courts.

    If the free speech, freedom of association and freedom of expression inalienable rights protected under the First Amend. are ignored by Art. 3 courts, under the false premise of public safety, then any action by Art.3 judges contrary to the Constitution they swore an oath to uphold,support and defend, is Treason to the Constitution, an office removal offense.

I have heard this many times throughout my time either working for my patch or moving up in the club; “The patch does not make the man, The man makes the patch.” Believe me I know what it is like to have pride in the patch, the symbol of a brotherhood, but what really holds a club together are the brothers themselves. They determine the success or failure of a club. If we are to survive as a lifestyle we may need to make some drastic changes in how we associate.

    I agree %100. Been saying it for a very long time. Now maybe people Will listen. Hopefully not too late for our kids to have this lifestyle as an option if they so choose. Respect to you Sir.

    Here’s the rub – no matter what patch you fly or support this decision is going to affect everyone at some point or the pother. It may not be tomorrow or next year but make no mistake, the government wants to have rules like Australia for bikers.

    I agree with Paladin (below) about the specific case, but the principle of, well, “crypto-nazi” coordination of control over the entire Country is ongoing, and there’s no force to stop or reverse it, not yet. I expect that no prosecutor will go to jail for treason to the constitution (the charges are obviously illegal in themselves). Instead they’ll just keep trying – their paycheck and political ambitions demand it. Yes, the specific case may end reasonably, but “they” are not going to stop with this effort…

    Judge Carter had previously dismissed this case based on First Amendment protections, stating that the Government’s case was “legally deficient”. Unless I’ve missed something, Rebel’s reporting on this trial hasn’t produced an illuminating discovery that would cause judge Carter to re-evaluate his previous reasoning for dismissal. The fact that the 9th Circus ordered Judge Carter to try this case doesn’t automatically mean the case has merit.

    “Carter expressed renewed concerns about the government’s theory given First Amendment protections, noting that self-identified Nazis freely rallied in Skokie, Illinois in the 1970s and “idiots” at the Westboro Baptist Church in Kansas have openly prayed “for the death of marines” because the nation enacted gay rights.”

    I may be overly optimistic in thinking that Judge Carter will rule against the government’s seizure of the Mongol’s marks based on First Amendment protections.

    Deep in, and after the club documentaries, time settled. The general public has viewed years of persuasive words, movies and daunting shows.     This could be a dead end no review ruling for the Mongols. The Supreme Court decide NOT to hear an appeal from a negative ruling from a lower Court. Nowhere to go,nowhere to hide. May just have to re-invent themselves…..?

    From a LE standpoint, taking the Mongol’s patch is a bad idea. Having taught urban and guerrilla warfare for many years. I have always known one’s perceived enemy is far easier to identify when in uniform.

    It would be interesting to see what would happen if some club or another would organize itself as a Political Action Committee, as the real issue here is freedom of speech and association…and an Nth “patch” is in reality a political statement. This would fail, but expose the bald fascism – that alone is historically important.

    Times change, and the “weapon” being created before our eyes may well be used against those who forged it, if History is a guide.
