Burning The Bill of Rights

The context of what happened last Saturday afternoon in Southgate, California when a heavily armed Deputy U.S. Marshall attacked a woman without provocation and destroyed her cell phone is clearer now than it was yesterday when The Aging Rebel first reported the story.

The Mongols and other motorcycle clubs held a fundraiser to help pay for the appeal of Mongols member Christopher Bryan “Stoney”Ablett. Ablett was found guilty in February 2012 of four federal racketeering counts in the murder of Hells Angels Frisco charter president Mark “Papa” Guardado in September 2008. Specifically Ablett was convicted of: 1) Maliciously murdering Guardado “for the purpose of gaining entrance, maintaining his position, or increasing his position within an enterprise (the Mongols Motorcycle Club) engaged in racketeering activity; assaulting Guardado with a deadly weapon “for the purpose of gaining entrance, maintaining his position, or increasing his position within an enterprise engaged in racketeering activity;” knowingly using “a firearm during and in relation to, the crimes charged in” the previous counts; and using a firearm “during and in relation to the murder in aid of racketeering of Mark Guardado, as charged in” the first two counts “and that the firearm was used to cause the death of Mark Guardado.”

Ablett was sentenced to life in prison without possibility of parole and a legal defense fund, separate and unrelated to the Mongols, was established by Ablett’s friends and relatives about six months ago. The defense fund has a website here.

First Amendment

News accounts of the Marshall’s assault published by NBC, the Huffington Post, the Los Angeles Times and London’s Daily Mirror all reported that a “multi-agency task force” had raided a Mongols “meeting.” “NBC News Investigative Unit” reported that the woman victimized by the Marshall was recording “a confrontation…involving members of the outlaw biker gang notorious for violent crimes called the Mongols.” Those news accounts were inaccurate and misleading.

There was no club meeting. The event was a peaceful assembly of American citizens engaged in a lawful activity on private property. The police were there to censor and harass that lawful activity in violation of the First Amendment to the Constitution which states: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”

There was no “confrontation.” The police harassment was not connected to any search or arrest warrants. The sole point of the action was to harass participants in a legal fundraiser intended to petition the government for a redress of what participants consider to be a legitimate grievance. Police never actually entered the property where the fundraiser was held.

Fourth Amendment

The multi-agency taskforce also violated the Fourth Amendment which states: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” Every person on the public street in front of the legal fundraiser was stopped, harassed, photographed and compelled under color of legal authority to fill out a “gang card.”

Police have not announced how many people were “arrested.” As a result of illegally detaining every person who ventured onto the public street, an unknown number of people were arrested for unresolved traffic tickets.

The Aging Rebel has confirmed that virtually everyone who was harassed was told that the harassment was punishment for associating with the Mongols. A commenter to this page reported that he was detained by ten policemen without justification and told, “Just so you know. we’re gonna be here all day pulling you guys over.”

The woman who was assaulted by a heavily armed government agent was assaulted to prevent her from documenting the illegal harassment – not because she was affiliated with the Mongols in anyway but to prevent her from exposing the illegal conduct of the police.

The name of the Marshall in the video below as well the names of those who planned, supervised and executed the illegal action last Saturday are being intentionally concealed from public scrutiny.

    @ Penguin:

The police-state will end when no more money exists to support it. The U.S. economy is in free fall, heading for the inevitable crash and burn.

Fortunately, fascists don’t work for free.

The cyclical, greed-driven, downturn of the U.S. economy will continue until the inevitable economic and debt crash and burn occurs. People don’t learn from past fuck-ups, therefore the U.S. will internally collapse to the point, where no-one will even listen to anyone in public office.

The West, Europe and the U.S., are in economic decline, as the East, especially China, is rising.

When the major ECONOMIC shit occurs, the police state cannot, and will not, survive.

Might want to look at this: http://archive.is/xHcrk

That’s a map of incarceration rates by country…and yes usa is Nr 1. Ain’t ya proud!

“Because of America’s aristocracy, America’s glory-days are over. As any sort of “city on a hill,” America’s best days are in its past, rough though those were. America’s long-term future is bleak. It starts that now already with the world’s highest percentage of its people in prison — the highest percentage in prison of any nation on the planet. If this means that it’s a police-state, then it already is leading the world as being that.”

@Paladin – Agree – failing to plan is planning to fail.

I always admire the skillsets and experience of posters here.

    Wolfenlover, Caretaker & the regulars,

Having been an Urban Warfare instructor, my advice has always been to keep you circle small and have a realistic plan. A plan gives one direction when others have none. If one’s plan has built in flexible, it will afford one options, when others have none.

If one enters battle with the mindset of one who’s already dead, fighting to win back one’s life, one will fight with the ferocity of a Berserker.

    Long May You All Ride,

  13. Phuquehed Says:

Thanks fellers. My best friend told me almost exactly the same the other day, “You being blunt just means your fucking honest”, they also took a saying from a movie I think it is and tell people I’ve ‘got no filter’. He saw how frustrated I was getting trying to explain Rebel’s articles and how much the pigs are fucking up and how they’re fucking so many good people over. He knows I’m more a ‘doer’ than a ‘talker’ just ’cause it’s easier for me, ha! (he doesn’t do the computer much no matter what the hell is going on, unfortunately, so he has no clue about some of the things Rebel writes about or covers)

  14. Asskiller Says:

@Phuqued – Blunt is good. There is enough bullshit in the world. You roll through Northern CO and I’ll buy you a beer any time.

  15. John Deaux Says:

    In other words. Fuck Em.

  16. AVAGOVFFV Says:

Your ability to articulate your position on subjects that your passionate about defiantly resonates with me and I’m confident with many others also. Me? I tend to just observe mostly and when I see people stepping on their dick or worse yet others I try to pass along some experiences that helped shape a young prospects life by men that mattered.

And this fucking creepy son of a bitch was making 160 grand a year (OUR TAX DOLLARS)

Thad Cochran’s office manager, Wesley Pagan, was arrested by the Feds for possession of 181.5 grams of methamphetamine. But his confession revealed an even more disgusting plan for those drugs.

A U.S. Senate staffer allegedly dabbled in drug importation, according to law enforcement. Fred W. Pagan, a staffer for U.S. Senator Thad Cochran (R-Miss.) allegedly told law enforcement agents that he imported drugs from China in a plan to exchange them for sexual favors, according to new documents filed in U.S. District Court.

Fred W. Pagan, who is 49 and earned $160,000 last year as Cochran’s personal assistant and office administrator,

did you take your name after the character in the movie pulp fiction?
you know, the butt fucking rapist in the pawn shop? if i remember it right
Marsellus Wallace got midieval on him and Butch Coolidge stole his bike.

  21. roachclip Says:

@ phu- Man don’t sweat it. I understand perfectly. I have trouble articulating also. You come through loud and clear. I just hope the child in question in zeds rant is not hearing any of this shit. He chose this himself when he started tapping that ass. I’m sure that was the first thing he was concerned with. Karma, what goes around comes around. I’m sure the boy will be just fine. As for zed, I think he has some issues about the responsibility of being a parent. Respects, roach.
