The problem with the war on terror is that it is a war on the Constitution decorated with American flags. The real goal of this war seems to be to prohibit nonconformity and dissent. And nothing shouts nonconformity and dissent louder than a big, modified American motorcycle. So one theater of this war is the war on bikers.

The war on bikers, and particularly the war on motorcycle clubs, relies on a long list of shady tactics. Here is a short list of the most obvious ones.

RICO

The Racketeer Influenced and Corrupt Organizations statute epitomizes what has been called “The federalization of crime and the criminalization of everything.” The law, which was originally intended to prohibit “racketeer infiltration of legitimate business.” In other words it was designed to prevent “the mob” from going legitimate. But in 1981, in a case called United States v. Turkette, the Supreme Court broadened the law by redefining the phrase “enterprise.” While the authors of RICO intended “enterprise” to mean a legitimate bar or bowling alley that had been corrupted by “the mob,” Turkette reinterpreted “enterprise” to mean “the mob” itself.” So now the law has become a way to enforce de facto “Bills of Attainder,” which are specifically prohibited by Article One, Clause three of the Constitution.

Civil Forfeiture

Civil forfeiture lawsuits always accompany RICO prosecutions. Simply stated, the federal government uses civil forfeiture to steal everything from people policemen do not like. You do not have to be proven guilty of any crime to have the government steal your stuff. Rather, police simply steal what they want and in order to get it back you have to prove you are innocent. Civil forfeiture proceedings are always characterized by loathsome gamesmanship on the part of government attorneys.

Extra Judicial Punishment

Cops have always beat up “bad guys.” But in the last generation highly militarized police have perfected a form of punishment called the Swat raid. Typically, bullies carrying machine guns break into homes at dawn, terrorize and humiliate the residents, kill the pets and wreck everything they can break. The raids are carried out on the flimsiest of pretexts – like indicia searches. In an indicia search, police target the home of a motorcycle club member or sympathizer to search for proof of his membership, like club memorabilia and photographs. Because the point of these searches is to punish people who have a right to be presumed innocent, they violate the Fifth and Fourteenth Amendments to the Constitution.

Surveillance

Police, particularly federal police, routinely commit all manner of searches and surveillance that violate the Fourth Amendment. That is the amendment which guarantees that Americans and all residents of the United States shall be free from unreasonable and general searches. But police justify searching computers and other electronic devices using flimsy and bogus pretences. And, police in disparate jurisdictions also surveil email, text messages and cell phone conversations.

Prohibiting Free Speech

In 2008, federal prosecutors began trying to outlaw motorcycle clubs by outlawing the symbols club members wear. The Mongols Motorcycle Club has been most burdened by this shredding of the First Amendment. Federal prosecutors have been trying to outlaw the Mongols by outlawing their patch. The goal is to eventually outlaw membership in all clubs that have not been approved by government officials, as the Night Wolves are approved in Russia. Australia, which has weaker constitutional protections than the United States, has recently gone so far as to formally forbid membership in about 25 motorcycle clubs and criminalize fraternization among club members, or more ominously, fraternization among people who have been secretly accused of club membership.

Justified public concern about RICO, civil forfeiture, extra judicial punishment, intrusive surveillance and attempts to limit free speech bisects racial, social and partisans lines. This war on the Constitution should concern the left wing and right wing, white, black, yellow and brown. All Americans should be concerned about the burgeoning American police state.

Save The Patch

The biker’s rights group that has formed to oppose all these police excesses and particularly the outlawing of motorcycle clubs is called “Save The Patch.”

Save The Patch is comprised of members and supporters of numerous motorcycle clubs. It was formed to protect the right to belong to a motorcycle club. The group is just getting off the ground but it has a real chance to bring some reason to the public discussion of the biker menace. And if riding a Harley is an important part of your life you should offer Save The Patch your support.

So you should be aware that Save The Patch is throwing a party this Saturday at The House Lounge, 3626 Fruitland Avenue in Maywood, California from noon until 6 p.m. The event will feature live bands, DJs, food and “Save The Patch” merchandise. It will provide an opportunity for people who might not usually speak to one another to unite around a common cause. And attending this event will be a relatively painless way to stand up for something that matters.

If you live in Southern California, particularly if you live in Los Angeles, and you care about the War on the Constitution you should try to attend.

Those who have fought and died have to be questioning what it is they fought for. The fucksticks in Washington are claiming they are protecting freedom and the American way of life. We’ll if this constitutes the American way of life I don’t want it. The lemmings of this nation blindly follow a corrupt Gov’t whose only true goal is conformity of the masses by taking away every freedom under the guise of security. I say it’s time to rise up as a nation and take this country back from the elitist’s whose only goal is to put the people under there ultimate control. Out founding fathered were radic rebels who put there asses on the line to obtain freedom and a way of life that allowed the individual to prosper without direct interference from the Gov’t. We as a nation need to take back this country by any means necessary and I don’t see that happening through proper channels such as in the electoral process. Any one elected will become corrupted and only out for personal gain. We need men of character and morals in order to get this nation back . Time for violent over throw of this country. Until recently it was allowed by law for the people to take back a goverment who no longer is protecting the people. The Decleration of Independence states ” that whenever any form of Gov’t becomes destructive of these ends, it IS the RIGHT of the PEOPLE to alter or abolish it , and to institute a new Gov ‘t, laying the foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety, Happiness. Prudence, indeed will dictate that Govt’s long established should not be changed for light or transient causes; and accordingly all experience hath shown , that mankind are more disposed to suffer while evils are sufferable, than to the rights themselves by ABOLISHING the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same I jest evinces a design to reduce them under absolute despotism, IT IS THEIR RIGHT, IT IS THEIR DUTY TO THROW OFF SUCH GOVERMENT, AND TO PROVIDE NEW GUARDS FOR THEIR FUTURE SECURITY. “.     It no longer means anything to identify yourself as a Republican or a Democrat. Neither party actually stands for anything anymore, and everything and everyone is manipulated by greed and a desire to get while the getting’s good.

    I’m not a big “conspiracy theorist,” but I do believe that, increasingly, the government is just a whip in the hands of big business and the ridiculously wealthy and powerful that really run this world.

    I mean, hell…it’s reported in the reputable press these days for a fact that Big Brother is here and has been for some time. What does Big Brother hate? Rebellion; nonconformity; independence; and freedom. All of the things that the Biker Brotherhood (and many others) cherishes.

    But to fight this battle it’s going to take ALL of us banding together; not allowing rifts to start in the first place, much less tear us apart; pleading our cause to anyone who will listen (this means not dissing the “citizenry”); and eventually aiming for the kind of clout that the NRA and other such organizations have.

    Think about that for a moment…a huge, powerful organization of patch holders and associates with as strong a voice and as much influence as the AMA!

    That should be the aim, and Save The Patch is a great vehicle to begin with, and might be the organization which carries all of us to the victorious end game.

    How about evolving a National Membership for Save The Patch with different levels for Patch Holders and all other bikers, with votes, dues (there’s the money for that war chest!) and reliable oversight. Get as many reliable attorneys on board as possible. Gain support and help from those who know how to make such things fly and who know how to aim at the targets that will do the most good.

    Maybe even form a coalition with ABATE and other biker organizations.

    The world is watching.

    Its Official…. writing my first book

    Just finalized the contracts with a well know publisher to write a book on “Lucky”. He is the last remaining original VAGOS MC member. There were 13 original members that formed the club back in 1966, only Lucky remains. This book will NOT be about club politics or what the club is now, it be about the fun times Lucky had rolling around on his Knucklehead chopper from the 60s to the 70s. A simpler time when the brotherhood was a little different, when brothers kissed on the mouth, and when the bikes were just as dirty as the cuts they wore.

    @OC VAGO 1%er: Thanks. I keep forgetting things are different on the West Coast. Last time I was there was 1976 at Camp Pendeleton being discharged. Bought my first Harley and a bag of white cross then rode to upstate western New York,(which was home at the time). That was a long fuckin’ ride especially on that cold hearted oil leaking bitch but it’s something I’ll never forget, especially the snow in Flagstaff. Had to crash once in OKC but 6 hours later I was back on the road & my hair started growing back. Had to stop occasionally for gas, coffee & a smoke. California is different and I sat thinking about that last night after I wrote that comment so I’m probably way off base. Brothers that I love and respect go to those NCOM meetings. Others I know rode with yours years back and were treated with every courtesy, a 45 patch was made to commorate that, wish I had been there.

    If I gave the impression that I in any way was disrespectful of the West Coast COC’s or Save The Patch I apologize as that was not my intention. Years ago I heard some bad shit about Lester but again, I really wasn’t there so my knowledge is so limited and out of date that it’s realistically useless. So, I shot myself in the foot on that one and I stand corrected if I’m wrong.

    Finally: Please keep my friend Mitch in your thoughts on April 1st. He’s headed for court and might get set free after a decades long confinement. He’s been through the ringer and then some but if he gets out he’s still young enough to enjoy life & ride. I’ve got 2 bikes and have invited him and his OL down here to ride to Key West & back on my dime, he deserves it. Keeping him locked up serves no purpose what so ever. Thanks. -CN

    Regarding Richard Lester: I have been involved with the COC’s since their inception back in the 80’s. There was a brief period of time when Richard fell out of favor of the clubs over some supposed conflict of interests back then, but all that aside; what the COC’s are today are autonomous organizations, brought together under the guidelines laid out by Lester all those years ago. He himself (and his offices) receive no dues or monies from the COCs. The dues we collect are used for our own operating expenses. If we give Lester’s offices any monies, it is only for work we’ve hired them to do. Many times and in many ways, Lester’s offices have done work pro-bono, and have offered free legal advice at every one of our meetings.
    It is understood that perhaps at the bottom of this may be the desire to have a client base, which Lester does have. But, for us IN the COC’s, the good things we gain from staying in touch with other clubs, communicating with other clubs, learning about anti-biker legislation, and how to fight it, far outweighs any personal gain Mr. Lester and his offices may realize.
    Further, it was Richard Lester who organized the yearly National Coalition of Motorcycle Clubs (NCOM) meetings, as well as the regional yearly meetings. Beyond our own hotel and travel expenses, no money is given to Lester.
    (Incidentally, the next NCOM meeting is this May 9-11 in Dallas. I will report next week with the details, or check the NCOM website:

    No, not the Sons of Silence. And certainly not the Sons of Anarchy, for this is a brief and 100% true history of a very real club.

    They were serious riders, and they flew colors. The behavior of the members, both individually and collectively, was such that they came to be officially designated as a gang.

    It is well documented fact that several members of the gang were: smugglers; arsonists; vandals; combatants given to violent public outbursts; rabidly anti-authoritarian; anarchists; and in disobedience to established law. They clashed frequently with law enforcement officers. Violence was an accepted and expected way of life: in clashes with authorities there were injuries and deaths.

    Many were drunkards; reflecting the behavior you would expect of such a Club many meetings were held at bars, with one haunt in particular being a favorite. As is typical of many secretive Clubs there was even a ritual whereby everyone drank from a communal bowl filled with alcohol; drinking from that bowl was a show of brotherhood and solidarity.

    Their increasingly deviant, secretive, and violent behavior began to attract more and more attention from the feds, and the Club began to press its cause heavily with the Citizenry in order to try and gain their favor. It was a pretty large propaganda campaign, and it flew in the face of everything that the authorities were saying about the Club.

    It finally got to the point that the Club and its members were labeled: the Club was now known as a dangerous gang and a terrorist organization, and its members were known as outlaws and terrorists. An outpouring of law enforcement was called for, an unprecedented show of force to take these outlaws down.

    But the Sons won.

    The full name of the Club: Sons of Liberty. The MC part? Well…they were serious riders, so let’s just say that stood for “Mustang (or Mare) Club.”

    And who were some of the more notable, but also reviled and dangerous members of the Sons of Liberty MC?

    John Hancock
    Patrick Henry…

So you assholes trying to stir up shit stop!!!! The save the patch shirts took off faster then we anticipated you can go to the facebook page and leave a message and someone will get back to you about the shirts. I’d like to thank Rebel and the other people who are helping make thise campaign successful.This is just the start of this. Get involved with your local COC or club to get with this. If the club that is cucurrently fighting this loses we are all next no matter how small or big your club is, YOU WILL BE NEXT !

    I haven’t commented much lately; life has been using me for a punching bag and I’ve been pretty much down in the dumps, but regards to the regulars. I’ve lurked in the background reading some, and I’ve missed the banter but haven’t felt like contributing to it. But I feel like a little piss and vinegar’s coming back into me, so I felt like mouthing off today.

    Just watched an episode of “America’s Book of Secrets: Hells Angels.” (Featuring our very own DCD! Hi, Rebel, you handsome dog you.)

    I mean absolutely no disrespect to any other club; I only say what I say about the program because they focused on the Angels, and my words are not meant to elevate any one club or brotherhood over another. That said…

    There were some interesting points about this program. It’s the only program I’ve watched that acknowledged blatant wrongdoing committed by federal agencies, such as the fact that feds watched the brewing storm between the Mongols and Angels at the Harrah’s Laughlin hotel/casino for approximately an hour and did absolutely nothing to prevent it, and in fact inferred that feds or CIs may have been on the casino floor helping to instigate the rumble that followed.

    The program also wondered about the distinct possibility that the feds may have acted illegally on several occasions in their overzealous persecutions, I mean…investigations, of motorcycle clubs.

    I have also been educated by the authorities who were quoted by the show to the fact that all motorcycle clubs are actually terrorist gangs. I wish I had known that before I returned the friendly waves I have received from fully patched members while riding my motorcycle. I wish I had known that before I had engaged in friendly conversation, which has usually included smiles and even laughter, with some of these fully patched notorious terrorists! Damn hell…I would have run the other way when these friendly outlaws waved at me, smiled, and held conversations with me. Lawsy! No telling what they were actually up to when we discussed bikes, the weather, favorite booze, etc. My god! Maybe I was actually brainwashed without realizing it. Well, from now on I’ll know better. Oh, hell…fucked up again! Here I am back on this damn message board with all of these dangerous terrorists. I guess my mind has been taken over and controlled. Damn terrorists.

    Anyway, I also learned from that bastion of civil service, Jay Dobyns, who was also quoted by the show, that the Hells Angels must have been responsible for all of the horror that has befallen him, AND that said Hells Angels are so enormously powerful that our very own federal government is helpless to protect Mr. Dobyns from their (the Angels’) agenda. Mr. Dobyns said that what we have seen is the “tippy tip of the iceberg.”

    This excites me no end. I hope it is true. Our government has fucked up so much shit; our leaders are of such enormously poor quality; and our protect and serve folk have transformed into a police state that would almost make Putin proud, that we need a sea change. And since the Angels are apparently all powerful now, let us hope that they become our new government.

    I betcha that those goddamn Big Brother cameras that are blooming like flowers everywhere would disappear. I betcha the ridiculous and restrictive motorcycle regulations would likewise go away. I betcha they might enact legislation that would protect a man who was protecting his family, instead of throwing him into jail for shooting an armed home invader.

    And the all-powerful Angels would enact peace accords with all other clubs, and then we could get down to business about how to practically handle the shit that’s going down in our country.

    I have hope, something that I haven’t felt in a long, long time. If the Angels are that all powerful then let’s hope they rise up and exert that power soon, before the U.S. goes completely down the tubes.

    A web-site for Save The Patch which shows whose running &/or funding/profiting from the show seems like a good thing. I’m sure Rebel has done his homework already on this as perhaps some of you have. Seems logical that a venue to support would/should have been one of their 1st missions. And, if Mr. Lester is involved he’s not known for being one to shy away from the lime light but if by chance he has the talent pool here should be able to bring that particular rodent to the bird feeder. Hopefully it’s all on the up & up and those of us who want to do so can support from a far should distance make personal support less than possible.

    Agreed, NO ONE should profit from this issue. But hey, you know those damn lawyers. FYI though, Mr. Lester presented a substantial donation to Save the Patch at the last COC meeting. And the new So Cal COC Chairman has begun to implement some good changes. One of which is full transparency of accounting.

    Save the Patch is the most important issue about our lifestyle in our life time. The possible negative outcome of the government’s challenge to our 1st Amendment rights will cause a ripple affect to each and every citizen in this country.

    I, too, would love to see a way to donate to the “Save the Patch” movement. California is about 3K miles away, and we are expecting rain and perhaps some snow. I’m OK with rain, but don’t like riding in the snow!

    This campaign is a campaign for what we in the USA consider constitutional rights, and what other civilized nations call human rights. It is vitally important if we desire to preserve a free way of life. I would love to see a “support the patch” patch. I would love to see decals or stickers — maybe to post in public places? I suppose a “save the patch” bumper sticker just MIGHT flag unwanted governmental attention….

    We are not likely to attract the financial support the NRA has generated in support of 2nd Amendment issues since manufacturers will probably not donate money to a campaign to protect 1st, 4th and 5th Amendment rights. However, we should be able to get support from other groups, just as the bikers in Australia picked up support from the unions. After all, if LEOs can interfere with our 1st Amendment rights, they can interfere with the rights of other groups they deem “unwanted”. I think that we should look at the Italian civil rights initiative based in NYC that was created to fight governmental excesses against Italian Americans back in the seventies — though it is important to remember that they actually assassinated a couple of those leaders…

    this is not a war on the constitution. its a war on individuals. the constitution is actually more on the side of the bad guys than on the side of the good guys. the bad guys get power, lawmaking, and armaments and jail. the good guys get the right to remain silent.
