Chutzpah

Chutzpah is a Yiddish word that means brazen audacity. The most common, folk definition of the word is “Murdering your mother and your father and then throwing yourself on the mercy of the court because you are an orphan.” Chutzpah connotes such a total denial of individual responsibility that it stuns bystanders speechless.

Chutzpah. Pronounced huutz-pawh. As in, “In order to get a job with the Pittsburgh Bureau of Police, first thing you have to flunk the intelligence test and ace the chutzpah exam.”

David Lincoln, one of the four drunken undercover cops who maliciously attacked four Pagans Motorcycle Club members named Frank Deluca, Michael Zokaites, Erik Heitzenrater and Bruce Thomas in a Pittsburgh bar named Kopy’s 11 months ago; charged their victims with multiple bogus felonies; then joined a police conspiracy to cover up evidence of the police crime just filed suit against the four victims. He is accusing Deluca, Zokaites, Heitzenrater and Thomas of attacking him. He is suing the bar for not protecting him.

Protect And Serve

The other drunken undercovers were Brian Martin, David Honick and Brian Burgunder. While in the bar, Honick consumed 13 drinks, Burgunder had 19;, Martin had 14 and Lincoln, drank a mere mere seven. Generally, men are presumptively considered to be legally intoxicated after consuming more than three alcoholic beverages.

Lincoln is seeking more than $75,000 in the suit in order to be made whole. The amount is a standard figure when filing a major lawsuit. Lincoln complains that because of the assaults by his victims and the negligence of the bar, he suffered physical injuries to his hand, eye and head and because his victims did not cooperate with the police cover up, his “standing in the community was negatively impacted, despite no wrongdoing on his part, resulting in damage to his reputation.”

SLAPP

Lincoln’s filing begs to be answered with an anti-SLAPP suit. SLAPP is an acronym for a Strategic Lawsuit Against Public Participation. It is a blatantly tactical legal action that isn’t intended to win anything except silence in cases of official corruption. The point is to bully and intimidate critics and opponents until they give up. On the face of it, that seems to be the point of Lincoln’s suit.

Arizona, Arkansas, California, Connecticut, Delaware, Florida, Georgia, Hawaii, Illinois, Indiana, Louisiana, Maine, Maryland, Massachusetts, Minnesota, Missouri, Nebraska, Nevada, New Mexico, New York, Oklahoma, Oregon, Pennsylvania, Rhode Island, Tennessee, Texas, Utah, Virginia, Vermont and Washington have outlawed what Lincoln is doing. Colorado and West Virginia have enacted other protections against SLAPPs.

But Pennsylvania has a very limited anti-SLAPP statute (if you want to look it up it is 27 Pa. Cons. Stat. §§ 7707, 8301-05) that only applies to SLAPP suits pertinent to environmental issues.

So now the four Pagans and Kopy’s bar can have a money burning contest with the police union until one side runs out of cash.

    The bar business owed Lincoln no duty to protect him, whether he started a fight, or not. Same as if two women are fighting over a garment at a store rummage sale, and a third one gets punched in the eye. The store business ain’t liable for the black eye.

    On Dmitry Orlov’s “Five Stages of Collapse”: He himself said it’s not as simple as saying which stage we are at. They are all happening in parallel, to one extent or another. He stated cultural and social collapse are very far along. Financial collapse is waiting for a trigger. Commercial collapse will happen in stages. Political collapse will only become visible once the political class gives up.

    The alternate view of Arnold Toynbee, who did not regard the death of civilization as inevitable in his “A Study of History” based on the rise and fall of 26 civilizations, is civilizations declined when their elite leaders stopped responding successfully and creatively to challenges, and the civilizations sank owing to the sins of nationalism, militarism, and the “tyranny of a despotic minority.

    According to Toynbee, the militarization of every pig shop in the nation is/will be one of the major causes of collapse.

    My Brother Sxxxxx tells us about how to detect snitches… Yes, this often works…and the intel folks know it..which is why they use them to distract the subject – so he does not recognize the ringer. KGB used to flood the operating locus with rank amateur spies to conceal the actual operative mechanism. STASI also did this. Perhaps this principle has not yet been applied in Tuscon….since it’s so provincial. I wouldn’t bet on it…

    I actually try pretty hard to avoid breaking the law…ever since some unpleasantness, long ago…which began my contempt for fools and violence.

    I believe that, just at this phase of History, that the established capitalist-fascist order (which which I can live alright) is facing very serious and absolutely basic zuswang – and has some vague idea of this – such that their basic emotion is a deep fear of Change. Thus the braggadocio and aggression, the hundreds (or thousands) of murders and rigged courts…their fear, as a class, both ruling class and their numerous quisling Clients – like cops – their fear of their own future makes them irrational and delusional.

    I never join – and I wonder why people do join, and study this. I am not the first to do this. Hegel, Feuerbach, Marx and others have described the “delta”, the human drivers, for joining – joining any “church” or “club” – as
    Entfremdung. Generally they hold that capitalism (I would say industrialism) creates the circumstance or condition of alienation. A club, even a neighborhood pub, can be a “cure” and a comfort. There’s a wiki on this.

    Of course there are people born into clubs, including bike clubs…and I have dated girls from one or two, in my misspent youth.

    In fair weather I ride, alone (almost always), but clubs, all sorts, interest me. Evidently they make the Power Elite afraid…but really the PE are afraid of themselves…

    One explanation for the cops’ fighting ability is that the drinks were hell of weak. It’s especially plausible if the bartender knew they were cops, and didn’t like them for that reason. Maybe he pissed in their drinks.

    Well, geewhiz…I do not understand you, and I think you have misunderstood something, but can humor your request…so, ok, “Sxxxxx” it shall be henceforth, if you like. Some may use you name, but not others? I had a dog like that, but he died.

    It’s awkward, but a fair question…the woods? Yes indeed. Years. I did well, but it was tiring.

    I suspected enlistment was a stupid thing to do, and did not enlist, but I did military training and did contract work, mostly for Signal Corps, some for DARPA. After 6 years I decided that they were delusional, fools and criminals, not simply foolish – and that there was nothing left to learn there. (There really couldn’t be any doubt, as about then they smashed Yugoslavia – a vast murder and crime – and tasked me with helping it it.)

    I have said – I study. Everything. Sometimes I write reports. I report to nobody.

    It must have been a thrilling experience in Tucson, very brave. I visited there and the place seemed like a monument to death, what with the museum Titan silo and the boneyard. So, I take it that you have fixed the Tucson copshop? A sterling and proud achievement, I’m sure. Good for you!

    Penguin please stop using my name for other commentators. Every Veteran knows why cops and other civilians are fucked up – they lack a common mission.     Now to dirty cops. Three years ago when I moved to Tucson the cops decided to take me down. I took down their snitches and some dirty cops. Snitches are stoopid. They give themselves away while they talk about the crimes that they want you to commit. Also, cops use the same snitches doing the same crimes over and over again with the same intended victims. All you have to do is keep your eyes and ears open. Have you ever been in the woods Penguin? It couldn’t hurt.

Considering that drunks drop easy, and these pigs attacked and didn’t drop easy…well, it does not take Daniel to read this story. Wired and drunk and aggressive piggies. We’ve all seen or experienced the way that goes. And I’ve listened to drunk cops brag to each other about stealing dope and then both using and selling – y’hear stuff down by the river, fishin’ at night. Voices carry.

    The coordination between “good” and “bad” cops is based on fear of reprisal opposed to promise of pension and status – and a mutual love for power. One son of mine went to copskool – and then refused a job. Went into union construction – it’s safer and better paid, and generally your brothers have your back, at least a little. Good.bad cop may be misleading though – they base their aggression on their perception of your class.

    The Batista topcop in “Our Man in Havana” said it best. There is a torture-able class, and a non-torture-able class. Hillary is in the latter. We’re in the former.

    We all know this is bullshit. Hopefully any judge with a modicum of common sense will throw this out immediately. On the plus side… the Pittsburgh DA will no longer accept sworn statements or testimony from any and all of these shitstains without corroboration from a second officer and then only on a case by case basis! These fucks should be, at the very least, deskbound pencil pushers from here on out. I personally believe this should be grounds for termination. The fuckin’ DA doesn’t believe a word you say? There’s the door.

    Law enforcement wonders why so many people are “Anti Cop”. I’m sure there are some good cops doing a tough job…. Blah blah blah. But you never hear of the “Good cops” calling out the bad cops. A cop never turns another cop in. Cops bad behavior can be on video and the other cops and cities defend them to the end. We are called “Gangs”. We protect each other. Won’t testify against each other. Wear the same “Colors”. Back up our brothers no matter what. That descripes every cop.

    When the police start holding their own accountable for their criminal actions, I will stop saying ACAB!!!

    Another thing, 13 drinks? 19 drinks?? Come on, They must have been doing lines in the bathroom. Back in my drinking day’s, the only way I could down that much booze was with some blow.
    Apparently the tax payers in Pittsburgh don’t care if their well paid cops drink on duty and consume illegal drugs.
