Pittsburgh Kops Gone Wild

From the beginning, it has been obvious what happened in Kopy’s Bar in Pittsburgh in the early morning hours of October 12.

Four off duty Pittsburgh cops went to the dive bar to get drunk. Three of the cops have remained anonymous. An alleged detective named Brian Burgunder actually started the fight when he leaned close to a Pagan named Frank Deluca who was sitting at the bar minding his own business. He  said something in Deluca’s ear. Deluca pushed Burgunder away from him.

If you watch one of the many videos that recorded the incident, your lying eyes will tell you that a few minutes before he was assaulted, Deluca offered his right hand to two of the drunk policeman who reluctantly shook it.

Six Cops

By the time Deluca was mugged, there were six Pittsburgh cops in Kopy’s – the four off duty drunks, an apparently sober uniformed officer and a uniformed sergeant. The drunken cops, one of whom could barely stand, had called for reinforcements in anticipation of starting a fight with the four Pagans, The sergeant has been identified as Matt Turko. The patrolman has also been granted anonymity.

Three policeman set upon Deluca. A cop grabbed each of Deluca’s arms while others punched him repeatedly in the face.

The four Pagans were immediately identified as Deluca, Michael Zokaites, Erik Heitzenrater and Bruce Thomas. The men’s police records show that between them they had two recent traffic tickets and one charge of non-contact assault. After they were attacked by police the four were all charged with aggravated assault, conspiracy to commit aggravated assault and riot.

Wheels Of Justice

The four Pagans appeared in court this morning for a preliminary hearing. The hearing was continued until November 16 because there is so much video evidence of the assault by the four drunken policeman was unprovoked that prosecutors have not yet had time to review it all.

Pittsburgh police continued to exercise the department’s right to say nothing, issuing a an unapologetic statement that explained “This is an ongoing investigation and to maintain the integrity of the investigation, we cannot comment except to say that all incidents involving the use of force are reviewed.”

After the continuance, defense attorney Wendy Williams told television station KDKA, “Our clients are minding their own business at the bar trying to ignore them. The officers are repeatedly going over, tapping them, touching them, trying to engage them,”

“The main aggressor in this incident is seen drinking a fifth and a half of Jack Daniels in shots over the course of four to five hours,” she said.

Defender Martin Dietz told KDKA “One of the officers brandished a firearm. He could barely stand. He was wobbly…. My client absolutely engaged in no aggressive behavior and he was what we call sucker-punched twice by an undercover detective.’

Deluca’s defense attorney Lee Rothman complained, “After this melee occurred, all seen on video, my client was restrained by four, possibly six officers and punched in the face after hair being pulled back and neck being pinched over 23 times in face and head.”

Most Pittsburgh news outlets continue to report that the drunken cops were working undercover looking for drug dealers and that, contrary to the video evidence, the four Pagans started the fight.

    Would like to see all the video. What I noticed was the “I’m a cop, I’m a cop, what the fuck is wrong with you?” The great offense appears at first blush to be Contempt of Cop. I sure as heck don’t see an aggravated assault, nor do I believe a reasonable jury would. I see people as passive as they could possibly be in the face of aggression that is in the form of authority.

    If there was a supervisor there, he should have taken control of the situation. Undercover or not, if the officers were drinking, and obviously enraged to the point of trying to antagonize someone who was already on the ground, then the sergeant failed in his duty, both to the citizens and the officers.

    For what it’s worth I agree with Neuro. Paladin is a smart guy and asset to this blog. I don’t have a clue why he chose to hate on me so long ago. Paladin will help you understand evidence and Law and procedure. As for myself I believe that’s all just BS and it’s more about “Good” vs “bad” as defined by the jury/Media. No matter what the evidence. This case in particular that DA knows exactly what happened but don’t care… He don’t care about the Videos or witnesses… If he can paint the 16 as “Bad” people (in the Media) the jury will find them guilty… Unless the guys can paint themselves as “good”. Keep posting Paladin… I’m gone until the next time. I had no urge to post these months until you said I was Oink…. That’s a fact. Am I crazy??? Your dam right. Most of us here are. I am but not in the way You think. I’m crazy for caring so much. I have a life… I’m headed to New Orleans its Halloween weekend again. ;) Same bat time, same bat channel. (BTW I remember in the 70/80s the 1st line of defense in court for 1%ers was to deny even being in a club… There was a method to that madness and a good strategy)

    Slightly off the subject at hand, but in the late 80’s maybe early 90’s I was working in Livingston, Tx staying in the only decent hotel in the area (with a bar) when 6 or 8 DPS officers cam in the bar in uniform, got shit faced, and decided to hassel everybody else in the bar. The were all still wearing there side arms. After a while the bartender chick said she was going to call the cops— they said “We are the cops, so what are you going to do about it” I just waited until it calmed down a bit and walked out–don’t how it turned out in the end.

    I wouldn’t necessarily consider you shallow. As previously stated; I believe we are who we are (prejudices included), based on our life experiences. I have never gone out of my way to be liked or accepted. People either like me or they don’t. In my personal and professional life, I have always done my level best to be fair and to treat people fairly.

    I have lived and continue to live my life based on a simple philosophy, which is: I do not lie, cheat, steal or unnecessarily lay my hands on others. Because I do not do these things, I will not allow them to be done to me.

    If one or all of those pigs were actually on the clock, getting fucked up for 5 hours in a bar, ostensibly undercover for “drug dealers” ( LOL that bar is what I used to call an “old man’s bar” a place to have a shot and a beer, definitely not a place a drug dealer would waste their time at), then the public needs to know this is where all that overtime expense is going towards.

    Kopys looks like a great place to have a shot or two with a beer or two but who on Earth would drink a fifth of bourbon over several hours in a bar? Shit, you can get a Quart of Evan Williams for ten bucks in the ABC store! Now who would drink like that in a place like that for 3 or 4 hours? Why, a pig getting paid overtime, that who.

    Pittsburgh PD is full of low life scumbags. To be honest, I don’t think these shitheads are the worst of the worse. But I think DeLuca is looking at at least $100,000 grand settlement.

I suppose you’ve created an unholy camaraderie there. I was being “cute”, as Rebel recently remarked, with the support comment. You have addressed the issue many times before, there are those who simply cannot accept or move beyond the fact that a fellow is or was a law enforcement officer, and as a shallow man, I fall into that group. Also I recall your comment “I was just out to keep the peace, but I would tell them ‘If I have to return, someone is going to jail.” Well, one time they came back, and hauled me off to jail for shit I had nothing to do with. Some douche deliberately drove a car down the sidewalk, tearing out some bushes in front of a house. We had shut the party down, people were all leaving, band was packing up. The Boys came back because they were called for the bushes. They feigned satisfaction that I complied with the shutdown order, but suddenly grabbed me and hauled me away. They also have used me as a practice dummy to prepare for the Rodney King beating, so I am not real wild about policemen. I am too shallow to get beyond it.

    I am not fan of the surveillance state we have nowadays, but the video here is going to prove what the cops and media are reporting isn’t necessarily the fact, even more troubling is that you can bet the Police pr spokesman was contacting the media right off the hope after they seized or reviewed the video footage to get ahead of the game and get their narrative parroted out to the public.

    The fact that the Police pr flack is saying oh we want to let the investigation take it’s course bullshit is because they already parroted out their version well in advance of the defendants lawyers getting to speak out about it, and that’s no coincidence

    It is a sad fact that a good many cops take the phrase “To protect and serve” to mean protect and serve themselves. Rebel keeps a watch on the “outlaw motorcycle frontier”. I keep a eye on law enforcement. Not to belabor the point, but I do see a certain amount of change in the works. Not too long ago, the Sheriff, Under-sheriff, a number of Lieutenants, Sergeants and line swine (deputies) in the Department I worked for were convicted in federal court of doing and covering up what took place in this story. In the past, the arrest, trial, and conviction of these crooked cops would have never happened.

    I have said in so many words elsewhere that giving a gun, badge, and authority over others to a twenty-one year old is like giving a child a pair of shoes several sizes too big. If they live long enough, they may grow into them, but there is a better than even chance that it will be at the expense of others.

    There are those of us that came into law enforcement later in life. We brought our life experiences with us. What we all had in common was the understanding that what is legal isn’t always right and what is right isn’t always legal. If young cops never learn this fact of life, they will never be able to keep the peace.

    @ Paladin – sure, there are examples of times where police are held accountable for their behavior. Thanks for digging up a few examples.

    My intuition is that is the small minority; granted, my intuition is biased by my personal experience (as everyone’s is). I’ve been around long enough to have several times experienced less than chivalrous behavior from those who wear blue. I’ve had cops give false testimony against me in a court in order to secure a conviction. I’ve taken my beatings and I’m still around.

    I will never trust a cop. I will never call a cop to report a crime. If someone chooses to commit a crime against me, it would be prudent of them to know how to defend themselves. But they won’t have to worry about me filing out a police report.

    When those who enforce our laws have become so corrupt, the only resort for the honest man is to become an outlaw.

    Paladin is a long time, well-respected poster to this site. He’s admitted many times before that he was in LE for a while, but has since left that business because of a dawning awareness of just how fucked up cops can be. I say KUDOS to him. I’d venture to say that his personal insight into all matters with LE has helped many who read the comments here, to a better understanding of what we, as a culture, are up against, and how to best survive the abuse.
    I don’t know you at all jrino, but your comments against Paladin are off-putting, and counterproductive here.

    Best thing about the initial police “story” coverup, is there insistence that the cops were “working undercover” That is a bad scenario for the city of pittsburgh, since it will now be sued, and the cops will also be sued in federal court under a 1983 action. In hindsight, and had it known about the videos, the narrative the City would have wanted to push was that the cops were off-duty, and acting on their own individually. Now their bullshit cover-up line is going to come back and haunt them.

    One cop holds the guy by his hair while another punches him in the head 23 times? If the assailant was even a fraction of a man he might have realised after a few shots “there is no honour in this”.

    Way back in time when I was a kid with his first chopped Harley, running around town, getting into a lot of trouble with the law, a wise old grey-beard said to me “stay away from the straight people son – they have no honour and they can’t be trusted”. I took his advice and my life got a lot easier. I am a grey-beard now (53) and I pass that advice on whenever I have the opportunity. I am not for a minute saying those guys don’t have the right to be in that bar, but personally I only drink amongst certified friends.

    In my country the police are called “the filth” and this is just one example of why. ACAB.

    If memory serves; Rebel reported on a couple of cases a while back where cops, masquerading as an MC beat a guy in a whisky row bar in Prescott, AZ and another case where a cop, masquerading as an MC member got into a fight with a guy who was fending off the cops unwanted advances toward his girlfriend. In both cases the cops involved were either fired, resigned, sent to prison or demoted. Rebel would have a better recollection of these cases than I.

    The point being: The cops don’t always skate. Hopefully; these assholes won’t either.

    Cops assault citizens that are in handcuffs, what else is new.

    It’s good to see these men are lawyered up. I hope at least one of those pigs drinking in that bar has at least one other complaint or incident of brutality on his record, even better if it was made by a negro.

    Just be glad nobody was shot and murdered. Roided up cops drunk in a bar is a bad, bad accident waiting to happen. Good luck, 16’s.

    My understanding is that when this event started, there had been 6 Pagans. Upon learning of the cops, 2 left. Frankly, all 6 should have left. Because this is what happens. Even with tons of video evidence, the cops are going to control the narrative. They will control the information that the main stream press regurgitates as given from the “public relations officer”. John and Jane Q. Public will believe it because they foolishly believe the police are there to protect and serve them. And thus the jury pool is effected and a fair trial is made impossible. And the cycle continues on and on and on.

    Eventually there will be a case (maybe this is the one) that the video evidence is so overwhelming, the exercise of police brutality and corruption so clear, that even the main stream media stops and goes “wait a minute, who are the bad guys here??”
