Twenty-Eight Days Later

Today, 28 days after the fact, Wheeler County, Oregon District Attorney Gretchen M Ladd finally informed “Victims in the Lisa Niehaus Matter” that the woman who killed three members of the Gypsy Jokers Motorcycle Club and injured nine others has been sentenced to 23 months imprisonment.

Last May 27, at the beginning of the Memorial day Weekend, Niehaus “crossed into the oncoming lane of traffic…on Highway 19 at about Milepost 60, a location just east of Fossil.” The pack was on its way to the 40th Annual Fossil Motorcycle Campout, a start of summer event at Bear Hollow Park sponsored by ABATE of Oregon.

According to Oregon public records for criminal case 17CR34692, National Crime Information Center record 239049TA4, as part of her plea and sentencing agreement, Niehaus pled guilty to three counts of criminally negligent homicide, two counts of assault in the third degree and two counts of assault in the fourth degree.

Another count of assault in the third degree, three more counts of assault in the fourth degree, seven counts of recklessly endangering another person and one count of reckless driving were all dismissed.

Organized Crime

Niehaus case was adjudicated entirely in secret and administratively. None of Niehaus’ victims or their survivors was ever even informed of the progress of the case.

Generally, under Oregon law, victims are allowed to tell a sentencing judge how a particular offender has harmed their lives. It appears to be Oregon public policy that: “A victim impact statement is the vehicle through which a victim of crime is given the opportunity to be heard before punishment is imposed. This right to be heard gives the victim an opportunity to express how this crime has affected them emotionally, physically or psychologically and provides a way to offer thoughts, suggestions and recommendations on a defendant’s sentence.”

In her letter, Ladd told victims and survivors that she did not notify them of the progress of the case before now because “a court” found “ that the incident”involved “elements of organized crime.”

Black’s Law Dictionary, parenthetically, defines “organized crime” as: “Widespread criminal activities that are coordinated and controlled through a central syndicate.”

Ladd’s complete letter states:

Dear Victims in the Lisa Niehaus Matter,

I am the Wheeler County District Attorney. I am writing to inform you of the status of the above matter.

Lisa Niehaus pled guilty on November 21, 2017 to three counts of criminally negligent homicide, two counts of assault in the second degree and three counts of assault in the fourth degree. The court sentenced her to 23 months in prison.

(Official, written records state that Niehaus pled guilty to third degree assault, not second degree assault. AR)

Please be aware that the 23 month sentence is an accomplishment in a case that has left members of the Department of Justice and the Oregon State Police divided as to whether a crime even happened. The alternative would be a careless driving ticket without any compensation for your losses. We believed a crime happened and prosecuted it accordingly.

Under most circumstances, the Oregon Constitution provides specific rights to crime victims. However, the law allows suspending some victim rights if a court finds that the incident involves elements of organized crime. The court ruled this incident was one of the exceptions to victim rights protections.

The crime victims compensation program is assisting each crime victim with lost wages and medical expenses not covered by insurance or the Oregon Health Plan. If you have not applied, please do so.

I have spoken with many of you. I have heard you describe the severe impact this catastrophic crash had on your lives and those you loved.

I have prosecuted this case with your interests in mind. I encourage you to contact the Crime Victims Compensation Program for financial assistance with medical expenses and lost wages if you have not already done so. Civil remedies may be available to you as well. Please contact a civil attorney for assistance with that.

If you have questions, you are welcome to contact the District Attorney’s Office. Once again, I extend my sincere condolences for the losses each of you have suffered. I understand the hurt and anger you have expressed in your emails. I know you are having to adapt to the physical, mental and emotional injuries of this catastrophic life changing event. I hope this letter explains why we had to handle the case as we did.

    I was reminded of the tragic incident involving the Wheeler County woman who collided head on with a group of motorcyclists by this online posting:

    This collision resulted in the deaths of three of the morocyclists and severe injuries to many others. Given the geometry of the road at the location of the collission, one is compelled to consider the possibility that this was an intentional assault and murder rather than a negligent accident. The hostility of Wheeler County citizens towards motorcyclists that is so well demonstrated by your letter to the families certainly encourages one to believe that this was a mass murder. Even if this lethal collision was a mere accident, your letter articulating the rationale for the secretive judicial proceedings that denied the victims of this crime their constitutional rights to due process can only charitably be described as gratuitously offensive.

    I understand the Gypsy Jokers Motorcycle club has a reputation for being a violent criminal gang. Some of the allegations against them are factual but many are exagerations. Given the fact that most of the interactions that Gypsy Jokers club members have had with law enforcement have involved the Portland Police Bureau, it is reasonable to presume that most of the allegations are paranoid fantasies. The recent incident involving the former Chief of the Portland Police Bureau who shot a friend during a drunken sage rat hunt is only one firearms travesty committed by members of that “law enforcement agency.”

    Whatever the history of the Gypsy Jokers motorcycle club, there is absolutely no evidence that they were engaging in any criminal activity at the time of the collision that would justify treating them as the perpetrators rather than the victims of the crime.

    I would like to disabuse you of the presumption that I am a member of the Gypsy Jokers or any other motorcycle club. Aside from a joint ownership in my youngest son’s Honda 150cc dirt bike, I do not even own a motorcycle. My criticism of your office and the Wheeler County Courts is motivated by common decency.

    As a crime victim whose brother was deliberately ran down by a robber who was interrupted in the act of stealing a garbage can (the perpetrator was Huesser, Mark Stevan, the date was February 15, 1989, the location was Wilsonville Oregon), I can attest to the fact that justice is neccessary to enable crime survivors to resist the temptation to become vigilantes. As I explained in my letter to the late Judge Charles Samms, society has a defacto covenant with citizens. Under this covenant, citizens relinquish the right to exact vengence in return for the State assuming the RESPONSIBILITY to hold criminals accountable. District Attorneys and the Courts that abdicate their responsibilities forfeit their moral authority if not their legal authority.

    By treating the victims of this crime with such utter contempt, your office as well as the Courts of Wheeler County have forefeited their moral authority to be the sole arbiters of justice. I would suggest that the Courts should atone for this injustice by being receptive to any civil suits against the perpetrator of this crime and the public officials who have aided and abetted it after the fact.

    If she’d just given the finger to a passing swarm of Trannies For Allah, on their way to their government jobs, the “organized crime” descriptor would’ve been all about her instead, and become the legal rationale for a hate crime charge enhancement. Politicization of the “law” is always the determinant of “justice”. Why else are all judicial appointments, always political, of such controversial concern? It’s because everybody knows their bias will be the basis of their decisions, where the wording of the “law” always seems to provide infinite wiggle room for anyone to say it means anything.
    Condolences to these poor guys, and all their loved ones. They were in the wrong place at the wrong time: That stretch of highway, Oregon, and 2017. Gretchen Ladd is simply a (supposedly) non partisan tool of the prevailing political powers, which if one draws back and takes a bigger look, seem pretty uniform throughout the country when bikers’ interests are involved. Waco is another current example, and thanks to the A/R’s archives, many more have been dragged into the light of day. Perhaps after she finishes kicking ass in Texas, Ms. Casie Gotro can take care of some more urgent business in Oregon.

    While her pockets may not be deep her insurance company will be the ultimate payer of any settlements, and hopefully after that her insurance rates will be so high she is never able to get behind the wheel again, I am sure she could but its be at a hell of a risk to someone who lets her drive unknowingly to their insurance company if she gets into an accident under someone else’s insurance

It would be possible to get a judgement against Niehaus in civil court, but I doubt if her pockets are very deep, which means the best one would be able to do is place a lien against any real or personal property Niehaus may own. Unfortunately, legal proceedings cost money and on the face of it I doubt an attorney would take this case on a contingency basis.

    Ladd’s letter is condescending, accusatory, insulting and incredibly insincere. I have little doubt that Ms. Ladd is completely dumbfounded when she hears of victims that take it upon themselves to correct her mistakes. What is legal isn’t always right and what is right isn’t always legal.

    The bulk of the charges are felonies. If I’m correct, a list of felonies like that should have equaled a pile of time in a penitentiary.

    My son was busted for possession of a controlled substance ( yes it was a schedule drug) that was for personal use which resulted in zero deaths, no injuries and no property damage. He got two years.

    Pretty fucking amazing.

    Oregon, another state to avoid like the plague!

    What? If there was that big a question, how did she wind up convicted on eight counts?

    Excuse me if I missed it but does anyone know what caused her to hit these victims? Did she fall asleep at the wheel, reached for something and lost control? What happened?

    This whole thing reeks of “we are scared and we can’t afford security to protect us”. The Court could just as easily have sent a letter out that limited the speakers to one per victim, not allowed anyone in wearing any club insignia, etc. Three of those counts involved people no longer here to speak for themselves. So apparently they were scared of their wives or mothers. That leaves five other victims – some likely unable to attend the hearing due to injuries but let’s say they all went… If each were allowed to speak separately, they couldn’t handle one injured biker at a time for a total of five? A cowardly way out. Shame on everyone of those players in the courtroom.

    I am glad that the victims at least got a letter; no reply to my email.By the way, the Judge should also be voted out of office in addition to the DA.

    My Googling confirms that Wheeler County has a serious problem with drug abuse. This is true of all of Oregon’s rural counties. The unrelenting economic warfare by Oregon’s urban elites who exploit the Spotted Owl and the Sage Grouse to dstroy the economies of Oregon’s rural communities has destroyed lives. Ongoing mechanization further erodes the job base. I expect that the antidrug crusaders of Wheeler County might have been scapegoating the Gypsy Jokers as the purveyors of Pot and other drugs that are corrupting their youth. God knows that a pack of three piece patch Outlaws riding their Harley Davidson motorcycles are far more discrete drug traffickers than some punks in a single, ordinary car.

    How, exactly, did this “incident” that killed 3 members of the human race, involve “elements of organized crime?” Were the 3 motorcyclists engaging in some form of organized crime as they rode blindly to their deaths? Were they engaging in some kind of criminal activity by happening to be on the road when Lisa Niehaus ran into and over them? Did Lisa somehow KNOW they were criminals, and exacted some sort of “justice” on them by running them over?

    What your letter stinks of, is an entirely arbitrary decision on your part, that these men, simply by being members of a group you don’t like, are somehow deserving of their fate. That somehow the victims are NOT deserving of proper recompense. That by being members of a motorcycle club, they are somehow not members of the human race, but of some lesser species, who, simply by existing, are allowed to be trampled upon by your antiquated, high-handed, genocidal thought processes.
