Uh Oh, Reyna's In Trouble

Defense attorneys in the Twin Peaks Biker Brawl case continued to attack the integrity of the McLennan County District Attorneys Office today.

District Attorney Abelino Reyna has been and may still be the target of a federal criminal investigation for bribery. The investigation began in the year prior to a scheduled meeting of the Texas Confederation of Clubs and Independents on May 17, 2015. Nine men were killed, 19 were injured, and 177 attendees were arrested.

Many of the arrestees were associated in some way with the Bandidos Motorcycle Club. They were arrested at Reyna’s assistance. In the days following the Twin Peaks incident, the violence was widely and inaccurately reported to have been instigated by the Bandidos. At the time of the incident, both the Bandidos and Reyna were under investigation by the Federal Bureau of Investigation and attorneys employed by federal Western District of Texas.

Broden Subpoenas

Today, Dallas attorney Clint Broden announced he has filed subpoenas to compel nine people to appear in McLennan County Court with documents relevant to the federal investigation of Reyna, They include Assistant District Attorneys Michael Jarrett and Amanda Dillon who are currently trying to convict Dallas Bandido Christopher Jacob Carrizal of conspiracy to commit murder and assault on behalf of the Bandidos at the Twin Peaks.

Broden seeks to compel Jarrett to produce “all documents, notes or emails produced at or created in relation to or in preparation for your meeting with federal prosecutors and/or FBI investigators in relation to the federal criminal investigation regarding McLennan County District Attorney Abelino Reyna” and “any and all documents reflecting the purchase or maintenance of a “covert” mobile telephone for the purpose of communicating with federal prosecutors and/or FBI investigators in relation to the federal criminal investigation regarding McLennan County District Attorney Abelino Reyna.”

Broden seeks to compel Dillon to produce “any and all documents, notes or emails produced at or created in relation to or in preparation for your meeting with federal prosecutors and/or FBI investigators in relation to the federal criminal investigation regarding McLennan County District Attorney Abelino Reyna.”

Broden has also subpoenaed attorney Joseph Layman, Julissa West, attorney Greg Davis, FBI agent Daniel Brust, discovery coordinator Heather Nering, Fred Rhea and Waco Police Detective Sherry Kingrey.

Professional Misconduct

Also today, Austin lawyer Millie L. Thompson filed a “memorandum of law” in support of her motion to disqualify the entire district attorney’s office from prosecuting the putative case against her client Thomas Paul Landers, “because conflicts of interest, bias, prejudice, and acts of professional misconduct have resulted, and will continue to result, in violations of Mr. Landers’s right to due process of law.”

“The disqualification should encompass the entirety of the District Attorney’s Office.” Thompson wrote, “for this reason: Reyna’s prosecutors have engaged in prosecutorial misconduct in order to shield Reyna. Specifically, Reyna was subpoenaed for a hearing on this very motion for a hearing that was to occur on October 20, 2017. Michael Jarrett, who interviewed with federal law enforcement officials against Reyna within the last five years regarding the preferential treatment of defendants in exchange for campaign contributions, failed to provide the defense with Brady notice of those acts of politically motivated prosecutorial bias. Amanda Dillon also interviewed with federal law enforcement on those allegations, and she failed to provide the defense with Brady notice of Reyna’s politically motivated prosecutorial bias.”

Thompson argues, “the district attorney’s office made itself a witness in this case by participating to an extraordinary degree with, and aiding the investigation of, the Waco Police Department. The Waco Police Department is a witness in this case, not only with regard to suppression issues, but also because it was present when the underlying acts of violence took place. The district attorney’s office has not taken reasonable steps to avoid entanglement with the WPD and, due to its participation, there is a very real probability that members of the office, including Abelino Reyna, will be called as material fact witnesses in the trial of this case. He will be called as a witness because he has a pattern and practice of picking and choosing cases to prosecute based on his own political gain, rather than seeking justice. In this case, Reyna overruled several seasoned law enforcement brass, who would not have made the sweeping arrests Reyna wanted, and Reyna effectively ordered the arrest of innocent witnesses – for his political gain.”

    Reyna blinked

“Reyna filed a voluntary recusal request after he was served with a subpoena to testify in the trial of Matthew Alan Clendennen, of Hewitt, who has been indicted on a charge of engaging in organized criminal activity in the May 17, 2015, shootout at the former Twin Peaks restaurant in Waco.”

    @ Rojas

    Yup he has

But lets not forget Reyna isn’t doing this because he in good conciseness move forward with conflict hang in the air, Reyna knew full well in light of everything that has come out in the last while that his ass was going to get booted, no way would it not have.

This is Reyna trying to save face an nothing more and while Reyna can try and trumpet this as him doing the right thing in the name of justice, that is all bullshit, everything that has came out at the Carrizal trial and all of Broden’s motions and revelations made Reyna toxic to sit at the table in Clendennen’s trial, it’s that simple.

There are still Broden’s complaints about not receiving all discovery that still need to be dealt with and the promises from the DA of making sure the defense gets all the discovery etc they were promised and they made that Promise to Gotro and as we have seen with Carrizal’s trial Gotro has not gotten notification of witnesses that appeared to testify that were not on the prosecutions list and of course discovery, documents and evidence that appeared at trial that the defense was unaware of.

So Reyna the bad ass DA is looking more like sad clown Reyna who cant walk and chew gum at the same time and Reyna pulling out of the second trial is not due to his own decision his ass was going to be booted he just wanted to save face because his little ego has been taking one hell of a beating the last week and half

So Gotro as well know has been complaining all along about not getting all the disclosure, so she subpoenaed the woman ( Brosch ) in Reyna’s office who catalogs everything related to cases that needs to be turned over to the defense and itemizes it in a database and on a hard list that is supplied to the defense.

Well apparently Gotro noticed that Brosch’s report was more than what her office had previously received and Brosch sent it to Gotro as soon as she got it. which means Gotro hadn’t gotten all of the discovery despite Reyna’s and Co’s proffer that she has got everything. Brosch said she gave Dillon a copy of the report in January.

So Gotro called Assistant DA Amanda Dillion to the stand to ask about this report, Dillon said she probably just slipped it in a file with other documents. Dillion said Brosch told her what she had, a half page, was different than her complete. Dillon said she doesn’t remember receiving it but she agrees it should have been turned over to defense. Dillon agreed that Gotro has complained often that she has not been given what she is entitled to. Judge Matt The judge is asking Dillon to check and see if she has other documents in her possession not produced to the defense.

What a clown show. Reyna and Co insist that the defense got everything and Gotro keeps poking holes in that story and now gets Reyna’s coordinator and assistant district attorney had to get on the stand and testify that Gotro never got anything and Johnson had to ask the D.A. to “double check” and make sure…. LMAO the appeal is writing itself here. so Not only has Reyna coming off looking like a fools so are those who work for him and good old Matt Johnson.

Now Reyna and Johnson will be having some late night alley chats as to how the hell Johnson can still find Carrizal guilty with all the failures that Gotro has brought to light so Reyna can save face and Johnson can make it it look like the case Reyna presented was so overwhelming that he had to convict Carrizal.

I swear the Feds and the State AG must be shaking their heads at the clown show that is occurring in Waco and scrambling with how to get Reyna out so they can save face

@ david; I have a hunch Jake/Casie didn’t file a motion to recluse the Judge or Reyna (maybe they did) in order to expose the DAs strategy and Casie will continue to show the Judge/Reyna’s Misconduct. I think it’s a set up. The Judge and Reyna are the target and this trial is the bait. There are SO MANY great appeal points and Misconduct that Judge Johnson… by allowing them…and not declaring a Mistrial puts HIS neck on the block. Sooner or later Cassie is going to motion for Mistrial and put all the ducks in a row to argue in favor of it… It will be so Obvious the Judge either has to grant the Mistrial or implicate Himself being in cahoots with Reyna. Remember Reyna is under Federal Investigation. Judge Johnson might be next. Someone is (or has) gonna turn. JJohnson has bags under His eyes and looks like He is under a HUGE amount of Stress. I’m sure Reyna has “the goods” on Him. Lots of Trials left DO NOT TAKE A DEAL no matter what! Drip, drip, drip and the dam will bust. Reyna MUST drop some of these charges against some of these defendants. KEEP THE FAITH!

  9. david Says:

Reyna’s massive trouble began when he, as a Judicial Branch member, commandeered the entire local Executive Branch of gov. by overruling every high-ranking cop, in their decision to NOT arrest the majority of people present at TP, and he subsequently ordered the cops to arrest all present.

The TX constitution is very clear on the people’s, written, guarantee of absolute Separation Of Government Powers inherent in the existing organic Law document.

When, as the result of a traffic stop, a pig arrests an individual, he does so without contacting the local judicial branch District Attorney to inquire whether he should, or should not, effect an arrest. Pigs being the enforcement arm of the statutes passed by the Legislative Branch, do not need to contact any legislators asking them whether they should arrest or have THEM present on/at the side of the road. And, they likewise do not have to ask any DA, even if the DA sticks his nose into what the TX constitution forbids the DA to do, namely, execute the statutes of TX.

Likewise, every pig present at TP did not need idiot Reyna, who has major problems obeying the written Law of the people of TX and the U.S., to make ANY decision whatsoever, the first day at TP.

Reyna, by his own actions, created all his trouble HIMSELF, at/on,and from, day one.He also, by his own actions from day one till today, DISQUALIFIED himself as persecutor of ANY of the 191 accused.

@Gandalf, with respect, any “defense strategy” before a biased, tainted jury of non-peers is irrelevant due to the FACT, idiot Reyna disqualified HIMSELF as persecutor at, and continually since, the initial arrests.

    2) Many defense attorneys have moved the court to rule Reyna disqualified, yet am wondering, has Jake motioned also via his attorney Gotro? Do not know, am asking.

    3) Absolutely no point, or lawful ability, for a persecutor with no qualifications to conduct ANY trial.

Twin Peaks biker’s attorney claims DA violated gag order

    http://www.wacotrib.com/news/courts_and_trials/twin-peaks-biker-s-attorney-claims-da-violated-gag-order/article_64d0254b-d356-5b48-be01-3832f8b73172.html

    From the story:

“attorney Clint Broden believes McLennan County District Attorney Abel Reyna has violated a gag order issued Monday and should be held in contempt of court, according to a motion Broden filed Tuesday.

Broden represents Matthew Clendennen, of Hewitt, the second defendant scheduled to go to trial in the Twin Peaks shootout.

Broden filed a motion Tuesday asking the court to show why Reyna should not be held in contempt for violating a gag order Senior Judge Doug Shaver, of Houston, issued Monday, barring communication with media outlets regarding Clendennen’s case, which is scheduled to go to trial Nov. 6. The filing states Shaver issued an oral gag order at about noon Monday ”

In the filing, Broden states Reyna continues to violate the court’s order by making comments to members of the media and keeping a Facebook post up responding to Broden’s previous claim that Reyna is under FBI investigation.”

    —————-

Well Imagine that Old Reyna breaking the law, who could have seen that one coming. Of course Reyna can’t abide by the rules, no sense in starting now. Just further goes how Reyna will use his office to violate and circumvent the law when it suits his interests. It will be interesting to see how many more hits the State AG and the Feds let Reyna take before they yank his chain because the stench emitting from Reyna’s office is starting to taint a lot of people.

Maybe this is Reyna’s version of crisis management in creating so many fires that it not only engulfs him but anyone else around it, kind of like that car crash that you cant help looking at even though you know rubber necking could cause another one. Tactics of desperation on Reyna’s part maybe?

Or is Reyna so desperate to make as much of a mess as he can that they yank him out and re-assign him or suspend him and his name fades away from the mess Twin Peaks has become. One has to wonder.

Nice to see the hits keep on coming for Reyna, it’s almost like the boxer that keep getting hit but is so punch drunk they dont know enough to stay down and end the beating, but in this case I am more inclined to want to see the hits keep on coming to Reyna and his ego

  14. Mark Says:

    @ Gandalf
The government using the media is like, death and taxes. They do it most everytime even on little things. The Fake News Media is just that, To win, one can not let the Fake News Media knock them off track, which is what the Fake News Media tries to do, control the narrative with propaganda, lies and half truths. It’s called, “Disinformation”, look it up and read about it, heavy stuff. Once a lawyers shows a jury the Media is putting out disinformation, the jury knows it’s getting it’s information from the government. After that in most cases the jury can’t buy into what the government’s attorneys are saying. The defence lawyers know that they have an extra target to help defeat the State’s case, prove the media is lying. Go back, remember the gag order? It was all about controlling the narrative that the media was about to lose control of. The truth is the key in this case for the defense not the State’s case. How many times have you seen me say, “proof without truth” is the whole foundation to the State’s case? The defence can’t get into a pissing match with the media.

  15. James W Crawford Says:

    Re Mark,
Agreed that we need to remain focused on the Twin Peaks Massacre.
I am just making the point that the Modus Operandi is very similar. Motorcycle Clubs should exploit knowledge of the Weaver and Waco 1 travesties to inform their own defense. MC members also recognize the need to form alliances with other types of people to survive.
The good news at Twin Peaks is that it was the police who had all the nasty looking guns and it was the police who did most of the killing. Also, there are no dead cops to exploit for propgnda.

  16. Gandalf Says:

More… Tim Madigan’s book about David Koresh was heavy with ATF info and Files not available to just anyone. It’s obvious Mr. Madigan has many contacts in the Waco ATF Office. Get it?

  17. Gandalf Says:

@ Mark; What Waco1, Waco2, The Weavers have in common is the smear campaign using fake news, scare tactics and propaganda in the Media. Nothing more. All these 3 incidents show a certain pattern that is The MO of the ATF. No Local City Police Force could get those stories written and printed and circulated as fast or as widely distributed. In Waco2 (Twin Peaks) The Only 2 Stories Tim Madigan wrote came out 2 days after and 6 days after. Through the Washington Post. Then He doesn’t write another one. Google Tim Madigan and see the book He wrote that smeared David Koresh as a Pedophile bent on attacking Waco and justifying the FBI/ATFs actions.

  18. Mark Says:

    @ JWC
I know the whole story, the FBI sniper who also shot and killed Weaver’s wife as she held her baby in her arms, by putting a bullet in her, forehead. Was there in Waco keeping the woman and children in the building by shooting them as they tried to escape the flames. I get it, but all of that has nothing to do with this situation that Jake is going through. My point was to get this full circle back to the situation at hand. Respectfully, M

Video of the last day documents that the FBI driver destroyed this segment of the building about an hour before the fire started.

  22. Gandalf Says:

It’s time to bring the ATF into this Trial. Casie needs to ask EVERY Cop and detective these 3 Questions 1st. 1- Did you see any ATF or FBI agents at Twin Peaks? 2- Do you know of any ATF or FBI undercover agents at Twin Peaks? Do you know of any ATF or FBI Confidential Informants who were at Twin Peaks that day. It does 2 things 1- Puts the ATF bug in the Juries mind. 2- When it finally comes out that The ATF/FBI had UCs or CIs there will be outrage that no Waco Officer knew and possible Perjury charges.
Casie also needs to call Tim Madigan and find out who gave Him the info for those 2 stories and why were they the only 2 stories He wrote. Admit the 2 stories into evidence. The Jury will see how wrong these stories were and see the Fake News. Suspect ATF involvement.

  23. Mark Says:

    @ Cowboy Dan
The AG back then was Janet Reno who was WJC’s prize. She served as his AG for 8 years, both his terms. Holder didn’t really come into the picture until the OKC bombing, to cover up that mess for WJC. Waco and the ATF were outed by Senator Fred Thompson during the senate committee investigation. ATF tried to pawn off, any part off anyone of the guns from the fire that would work on a full auto counted as a, Machine Gun. Against the law which states the receiver is the gun and only the receiver. So no Machine Guns were found. So ATF switch to the children were sexually abused. The county sheriff refused to back ATF on this, saying that was investigated in detail and there was absolutely nothing to support that claim. The lies in the Fake News Media saved ATF under the direction with the Clinton propaganda machine. None of that players then play into what is going on today, all of those people are retired by far and large. ATF did the Waco scam because congress and the DOJ, was looking at combining the ATF into the FBI. The agents in the FBI saw the ATF as a bunch of retards that didn’t know what being professional was about. ATF used the Waco plan to show they needed to remain as they were, a separate LE unit. The ATF did get removed from the Treasury to the DOJ but not combined with the FBI. The connection is, the ATF has shown a willingness to go political. I don’t see such a conspiracy with the ATF in this matter. Keep your eye on the FBI and the DOJ attorneys for any connection and communication between Reyna with them. There players always CYA on the federal level and if Reyna gets too hot, he will become a Sabbath lamb. Everything will fall into his lap.

They have a long history of hinky deals going south in a hurry right outside of town. Who was the AG back then, was it Holder or Lynch? Holder was up to his eyeballs in the Branch Davidian debacle and was on the phone with the Gonzales family right before they busted down the door in Miami. 34. Mark Says:

I made a point to post awhile back, the COC meeting was changed from Austin to Waco, with no known explanation why. As far as I have seen. Could all of this been planed by Reyna and company, I’m talking the whole damn thing from top to bottom. Could this have been done to scapegoat the BMC to win favor with the feds to make their Reyna investigation go away? Frankly, it’s becoming pretty damn easy to connect the dots and come to that conclusion and without the conclusion being a reach, whatsoever. I can’t figure what overview to call this whole thing, a conspiracy or a cluster fuck.
Side note: Some testimony seems to be vary damaging to the states case. That makes it clear the CMC set the trap on the BMC and they/CMC were abusing nonoutlaw riders from the very start once they got there. Well before the BMC arrived. Crazy!

If this is true in this case (as it relates to Dillon, Jarrett and Reyna), then wouldn’t it follow that each and every case in which this trio has had a hand in prosecuting since 2014 has the same very serious issues?

We could be witnessing a real-time, Old Testament style, Biblical level smiting (or is it smoting) of McLennan County. Hopefully there are a lot of underemployed appellate attorneys in Waco to assist in the Lord’s work.

  37. Aanon Says:

Shame, shame, shame on you. A+ for Mr broden on my report.

  38. Wow! just wow... Says:

And Reyna et al., claim the Bandidos are the “criminal organization”!

  39. Iron Rider Says:

FUCK! Did it again! I am laughing so hard at Reyna right now that I am making mistakes typing. Hit enter by mistake AGAAIN sorry folks, Sorry bout that Rebel

Rebel’s reporting that Reyna was under investigation was correct as were Rebel’s source and since we now see other reporters jumping in on Rebel’s revelation that Reyna was infact Under investigation, Reyna’s claims that this is un-true and rumor and innuendo are about as hollow as his pursuit for truth and justice.

Broden and Thmopson along with Gotro have all claimed shenanigans on the Distirct Attorneys office and now comes this little gem in the Waco Trib:

Twin Peaks biker’s attorney says email proves DA Reyna under federal investigation

Waco attorney Robert Callahan, who is representing biker William Chance Aikin, of Talco, released an email from FBI agent Dan Brust to Waco police detective Sherry Kingrey and two other local investigators sent in February 2013. In the email, Brust asks all three investigators about unspecified information regarding “potential corruption,” and possible information confidential informants may have.

    ——-

So Reyna has been playing the misdirection game of Deny, Deflect, Delay when it comes to questions about his office and their undertaking with Regards to Twin Peaks and the District Attorney’s office obligations to defendants and their counsel.

Now we all will be watching to see what the Texas Attorney General and the US DOJ do and how long they will tolerate Reyna running around in his clown outfit honking his horn while sewering these Twin Peaks cases and virtually guaranteeing everyone and appeal that ought to have their cases dismissed or back to trial where they stand a great chance of being found not guilty on retrial.

Think about that fact that US DOJ probably thought these cases never should have been brought to trial save for a few, but yet the Feds are now entrenched into this because of Reyna, the State Attorney General must be wondering what embarrassment was next when he checked the news at night to hear the latest goings on with the Twin Peaks case. One has to remember that Waco/McLennan county have a long long line of Law Enforcement failures that in turn dragged the District Attorneys office into the spotlight as the highlight of incompetence and a long questionable history that borders on corruption and incompetence and no one likes to have the can tied to their backside because of someone else’s idiocy.

The more Revelations that come out of discovery not being turned over, witnesses not on the prosecutions list, Reyna/Johnson Strothers ties to other scandals in Waco, The failure to reduce bias and the perception of impartiality that has been called into question many times, the fact that Reyna consistently has made misleading statements, testimony before the court By Reyna himself that may lead to perjury charges and the list goes on and on and the list grows with each passing day.

It will be interesting to see how much tolerance will last where Reyna is concerned because Reyna and the prosecution are sinking fast and the stink that is following Reyna around will soon start to taint others in the DA’s office. Waco may have an old boys club looking after one another, but sooner or later people are going to see Reyna as damaged goods and are not going to want to go down with the ship and Reyna at the helm, they are going to want to jump overboard to save themselves

It’s no wonder why Reyna wants to delay Clendennan’s trial, with the tire fire that Carrizal’s trial has been and the misconduct from the D.A’s office and accusations levied against it, Reyna is in desperation modes to make it stop

Reyna is going to get that Federal Job he wanted, “Leavenworth Kitchen needs dishwashers.” (careful what you wish for…)

Whoops hit enter by mistake sorry folks

So Reyna has been playing the misdirection game of D

Who posted on an earlier post about DEA agents telling Abel to do Twin Peaks because it could make his Career?

  44. just tom Says:

Thanks Rebel for the good info on this case. Looks like Reyna may up to his waist in alligators. Keep up the good work.

  45. david Says:

Lander’s Memorandum is one of Law, not speculation, evidencing every single organic constitutional Law the POS Reyna HAS already violated, and how he did it.

Having read it, if the court does NOT disqualify the pig sty which the entire office is, the court itself, is as corrupt as Un-Abel and the entire DA office.

Idiot Reyna is so far into his power-trip, next is his fall.

  46. TX_Biker Says:

please let this finally start to unravel the fabric of lies Reyna and the Waco PD have knitted in this travesty of justice.
