Barroso Can Appeal

Mario “Paco” Barroso took another step toward appealing his sentence yesterday in thr grim and endless Iron Coffins Motorcycle Club murder case in Battle Creek, Michigan.

Chapter president Lee J. “Leeroy” Taylor wound up dead after a clubhouse fight on New Year’s Day 2012. Allegedly, after a brief but intense scuffle with a man named Matthew Starkweather, Taylor stormed out a bathroom with a baton in one hand and a knife in the other. John Lindahl III. Allegedly, beat Taylor off Starkweather with the butt of a shotgun. Barroso handed Lindahl the shotgun. Taylor died.

Starkweather, Lindahl and Barroso were all charged and then had their charges dropped by a prosecutor named Susan K. Mildenoff. Then there was an election. The biker menace in Battle Creek was one of the issues. After Mildenhoff lost, a new prosecutor named David Gilbert went after Starkweather and Barroso but not Lindahl.

Starkweather spent 405 days in jail before pleading guilty to a charge of assault with intent to do great bodily harm so he could get out. He was sentenced to time served in November 2016.

The Case For Pro Se

Barroso, who is now 68, had already decided to plead out in order to finish his legal ordeal while he still had time to end his life free. He pled guilty to manslaughter with the expectation that he would be sentenced to 38 months and do about half of that. Two years ago, a cruel judge named Conrad Sindt sentenced Barroso to 71 to 180 months in prison instead. “I am struck by the idiocy of grown men acting like children,” Sindt said as he looked down from on high.

Barroso wanted to appeal. His lawyer, Seymour Schwartz, quit the case because he doesn’t do appeals. Someone wrote at the bottom of the appropriate form that Barroso was declining his right to appeal so the formal appeals motion wasn’t filed on time. Barroso was the last to know all this. He is currently incarcerated at the Lakeland Correctional Facility in Coldwater, which is in the middle of nowhere about 30 miles from the Indiana State Line.

Schwartz was back in court yesterday to testify that he doesn’t know what happened but Barroso definitely wanted to appeal. It is all a great mystery.

Then a judge named John Hallacy said he would appoint an attorney for Barroso so he could appeal.

    The only accurate reporting on this case for the last five years has come from the Rebel. There was never a killing over money; the prosecution alleged that. They also alleged Matthew stabbed himself in the neck to give him a defense. Anyone who would like to stab them self in the neck for a defense please do so. No one is turning over in their grave. This is been prosecutorial misconduct in for five years.

    This case is one that David Gilbert should have never reissued. He did so in an election year looking for “good press”. Durning Matthew’s case his attorney had Gilbert recused because he had acted as a defense attorney for Lindhal and had knowledge of the case. The same judge as now ordered Gilbert and his entire office recused. With that in mind Gilbert met several times the the new special prosecutor, Victor Fitz; Fitz was then recused. In Matt’s case, we went through 5 prosecutors; his last wanted this over as much as we did. I filed a complaint about Gilberts actions with the Attorney Grievance Commission; Victor Fitz is a member of that group. Although they did not admonish Gilbert, he did receive a strong warning and was told he should have never been involved in this case. I’m not certain what Barroso’s appeal will contain but one thing must happen and that is to show Gilbert’s misconduct. Good Luck…..
