Revenge Porn Tank Art

Timothy James Brandt of Minnesota Lake, Minnesota, was charged this week with decorating his motorcycle gas tank with a topless photo of his estranged fiancé. Minnesota Lake is a town of 657 about 30 miles south of Mankato and 85 miles west of Rochester.

Brandt is charged with nonconsensual dissemination of private sexual images, which is a gross misdemeanor under Minnesota law punishable by imprisonment for not more than three years or a fine of $5,000 or both. The woman, who is not named in the criminal complaint, voluntarily posed for the photo during happier times.

The same woman had Brandt (above) charged with two felony counts of kidnapping and two misdemeanor counts of domestic assault at the beginning of April. She told police that he had coerced her into staying at his residence. She complained that she was afraid of him because he had been physically abusive to her and that he had intimidated her into staying home from work that day. The charges were dropped but she secured a restraining order against him.

Brandt was ordered to stay 100 yards away from the woman but earlier this month he rode his motorcycle to a city park, twice, where her son was playing baseball. The woman told police he was staring at her from a distance of less than 100 yards. Allegedly, he was in possession of a BB gun and a folding knife at the time. Consequently he was charged with a felony violation of the restraining order.

Brandt might have avoided the revenge porn charge but after he made a decal of the topless photo and put it on his gas tank he took a picture of his new tank art and posted that to his Facebook page with the caption, “Beautiful day to show off the old lady, lol.” Posting the photo to Facebook and insensitively captioning it made the image “revenge porn.”

Subdivision 2, paragraphs (4) and (5) of Minnesota statute 617.261 state it is illegal to disseminate a topless image with out the photographic subject’s consent if “the actor posts the image on a Web site” or “the actor disseminates the image with intent to harass the person depicted in the image.”

    Bro of mine caught his old lady in the sack with someone else. I imagine both thought they were about to achieve room temperature (my Bro has a well deserved hardcore rep). Instead my buddy smiled and congratulated the Jody “You just took over payments, Asshole.”. In a week he had a new house mouse, blonde, blues, and seriously hard body.     Let’s see now…faced criminal charges that wound up dismissed in April, a restraining order issued, violates the restraining order and then just can’t resist getting another criminal charge filed? Some days, I just have to pour one and laugh.

    I understand the motivation for “revenge porn posts”. When a formerly-good relationship is destroyed, who hasn’t been frustrated, angry and upset at the loss. I don’t think “revenge porn” is a good way to deal with the situation, but I do understand the impulse to post photos of the happy times both as revenge and as a demonstration that things were not all bad.

    The intense emotions that are aroused by a breakup inspire thoughts of “getting even” and “see how good things are now that you are gone”. Photos of new boyfriends and girlfriends (sometimes completely imaginary) are pretty common. Fictitious stories posted on FakeBook, photos and vacation tales are common.

    I sometimes have trouble deciding whether different photos are the same person, and the effects available with Photoshop are really remarkable. People (who know more than I do) can switch faces and even tattoos onto another body, and make it look believable. So my question is, “was it even his former fiance’s photo?” How do the LEO actually prove that it is who they claim? The addition or subtraction of different elements could call all the supposition into doubt.

    This is just crazy. Was it a bad pic? The gas tank make her look unflattering? Sounds more like the revenge of a scorned woman, hell hath no fury like…..

    At least there was no mention of a club, otherwise that picture may have been linked to a prostitution ring.
