Vagos Murder Twist

The investigation into the apparent murders of two Vagos named Scott Gardner and Brian Davis took a weird twist Wednesday.

The two men died of injuries sustained in the parking lot of a bar called the Sportspage in San Bernardino, California at about 7:30 p.m. last Sunday. Their alleged killer was another Vago named Beau Gabriel Hempel. A police spokesman declined to list Gardner and Davis’ injuries. The spokesman did say, “There was an altercation in the bar that spilled out into the parking lot. It looks like the suspect and victims all knew each other…. All of the involved parties are members of the same outlaw motorcycle gang.”

Hempel fled the scene on his motorcycle and turned himself in to the San Bernardino County Sheriff’s Morongo Basin Station sometime during the night. The station is about 60 miles from the Sportspage and Hempel lived in nearby Joshua Tree, He was formally arrested by the San Bernardino Police Department at 7:00 a.m. Monday and charged with two counts of first degree murder. Both counts carried mandatory penalties of either life in prison or death.

Hempel was born in  Mabank, Texas on March 21, 1979. He spent a night in jail for assault in Las Vegas in December 2011. After his arrest he lived with his father in Seattle and he moved to Joshua Tree before April 3, 2002. He likes motorcycles and tough dogs. His criminal record in California appears clean for the last 15 years except for 11 traffic tickets.

A member of the Vagos, speaking anonymously, said, “Beau was very respected. Everyone is pretty shocked.”

Release

After his arrest Hempel was booked into the West Valley Detention Center in Rancho Cucamonga. Bail was not set and there is no record that he was ever represented by an attorney.

Thirty-four hours after his arrest Hempel was released from custody without bail. There is currently no record of the murder case with the San Bernardino Superior Court and the matter appears to be closed.

It is unusual for a double murder case to be resolved so rapidly and extrajudicially without any official explanation.

    @ Tom Barker. If a person believes a man is Guilty because He was arrested doesn’t it make sense that the same person should believe a man released without bail or charges is Innocent? QUOTE: “but one thing is for sure this is some crazy stuff and it’s club business so we will never know. Thanks for the update Rebel.” Why can’t people just accept that and move on. Let these guys morn in Peace. Jezzz I’m thinking Rebel wrote this simply as info for those who might need to know… Not so we can speculate what “really” Happened.

    Tom, I guess that would depend on how you define “authority.” Government doesn’t hold any magical power that gives them “authority” over anything. We delegate certain things, sure, and some would argue that power comes from the consent of the governed, but those who live the 1% lifestyle don’t give their consent to be government by anyone outside of their club. The club will absolutely have the final say over how their business is handled. Through the decisiveness of action, every club must clear their own path using their own rules.

    Actually, Mr Paladin, homicide is a public injury whose outcome is settled by the state, not a group however defined or constituted. The settling of public injuries by a “group” however defined ended in this country with the demise of the Slave Patrols–pre civil war in the South-and the vigilante groups in the West in the early to mid 1800s. No group in the United States has the final authority to settle a public injury.

    If the members of the club do not testify in court, that in and of itself will carry weight. If you think that the court is going to have the final say in all of this, you’re delusional. What the club decides will be final.

    Definitely interesting!! Bunch of Vagos calling him a stand up guy but he did kill his diamond back and another brother!? His brothers claim he’s Cali born and bread attacking Rebel but it’s clear he’s from Washington!? Lots of questions with a lot of different answers.. I would never call someone a rat or a cop with no paper work but no charges on a double murder of ones own people is serious. I do find it very curious that none in the Green Nation are speaking up for a dead president! There are quieter ways to clean house or move up the ranks. The fact support seems strongly in support of the shooter says a lot. Wonder if we will ever know the truth but one thing is for sure this is some crazy stuff and it’s club business so we will never know. Thanks for the update Rebel.

    The testimonials posted for the young man originally arrested for murder give me cause for concern. He sounds like a rational young man who would be good friend. That leads me to consider another POSSIBLE scenario for the homicides. I am at a disadvantage in offering this “opinion” because I usually have read the reports, all forensic information, including autopsies, so I could be wrong, but suppose that the original altercation was between the two dead victims, who may have had a history of bad blood. The third man–who was initially chaged only went outside with them to act as a mediator/peacemaker. One of the victims killed the other and assaulted the third man who acted in self defense. He fled the scene because he was afraid of the police response and later turned himself in. If he is charged and brought to court some club member will have to testify in his behalf to convince a judge or jury. Now, if this scenario has merit, his brothers reluctance to testify could be disasterous for him. As, I said before the “clubs” decision as to what happened has no weight in court.

    It is glaringly obvious most courts in this country are money-corrupt as hell. If a corrupt Cali. court hears a prosecution, witness testimony becomes questionable at best, if there are even ANY witnesses at all.

    I have to agree with Neutron. As a Paralegal in Arizona I have seen many felony charges “dropped” just to be picked back up again later. In the cases here the DA thought that he had enough to get the conviction but he wasn’t 100% sure so he puts it in front of the Grand Jury. If the Grand Jury hands down an indictment the DA seems to think that means that a jury will convict at trial. It’s basically how they test cases and the evidence. One of my professors said “A grand jury can indict a ham sandwich if they want” and to be honest, I believe that a few that have convened would seriously indict that sandwich. Being a grand jury member gives a lot of people a false sense of power and they run with it. I’m in no way saying that this is what’s going on here because I don’t know. I also don’t know what really did or didn’t happen but, it does sound like a club matter to me. Unfortunately, club business or not, 2 people dead in a parking lot tends to make this news no matter the circumstances.

    I have personally known Beau for well over 10 years. To see anyone suggest he is a cop or CI is a fucking joke. Beau is a natural born leader, a man of principle a loyal dedicated father, husband friend and brother. A man that would gladly give you his last dollar or the shirt right off his back. He has been an outlaw since the age of 12 running the streets of Seattle Washington. There is alot to this story that is nothing but club business. I felt it important to stand up for my brother. If the DA had charges that would stick they wouldn’t ever let him go. Respect and condolences to those who lost their lives and have been affected by this tragedy.

    In Ohio, felony charges will sometimes be ‘dropped’, only to be later picked up by a seceet indictment by grand jury. Maybe that’s what is happening here?

    It’s really too early on to say for sure, but I imagine that those need to know what happen, do. Outsiders speculating he is in any way affiliated with LE is disrespectful and absurd.

For sure there ARE some reading this post. Hi guys, how’s the donuts? With his long track record the chance he’s a cop is zero. No way any agency could or would run an agent that long. From the statements of those that knew him and the fact they cut him loose like they did I would say the chance he’s a CI is effectively zero as well. If he was a CI they would have held him longer for show. To throw off any questions others might have. By cutting him loose so quickly the LEOs show one: they don’t have diddly squat.     I’ve known Beau personally for over 30 years, every decison I’ve seen him make has been befitting of the circumstances. I guarantee his actions were the only reasonable solution to that situation. And anyone that doubts that, clearly doesn’t know my brother or love him as much as I do. As knowing him longer than anyone else that I know, to doubt his loyalty would be nothing less than a slap in the face. I would trust him with my life. Him being a loving father to two kids and being a loving husband, I’m certain he wouldn’t jeopardize that unless the circumstances were that dire. My condolences go out to everyone that suffered a loss from this situation.

    It’s no longer “news” if one must wait till “all the facts” are reported.” (When does that ever actually happen, and whose “facts” anyway, and how can one ever know whether that’s finally occurred)? Journalism can’t be all that rewarding a profession. Everyone tunes in, but not everybody is ever happy with the product, for more different reasons than there are words to use. One certainty here though, these deaths are a tragedy, and the sad ending of these men’s lives should be noted, and it was. Beyond that, I’m sure Rebel will continue to do the right thing.

    I have known Beau many years. I see the Video with Beau at the Cinco Bully Show thats my event for last 11 years and Beau is always there with family and freinds. He kicks it at my Booths with all our freinds . I been to Vegas where Beau hooked me and my wife up with our room in Vegas for a weekend ,Beau kicked it at ABKC Nationals at my Booth with other freinds and Beau hooked our group up with Pizza. I see people on this issue that know Beau like I know him a level headed guy with a Bigg heart. Beaus love is his Family, Bully Dogs and the Vagos. Im not a Vago dont know any of this buisness but I know Beau is Loyal to his freinds. My family has Hooked Beau up with Comped rooms at the Casino where we ate and party together and I dont have to worry about a side Bill for any problems and its always a good time like up in Bigg Bear we rented a Cabin we had a Blast with a Bigg group of people that respect Beau . When I got out of the Hospital I could hardly walk I was down and dont like anyone to know and Beau can read me he came out unloaded and carried my stuff to his spot . He showed me alot of love and respect. This is a sad situation I dont get on post or into others buisness but I gotta speak up for Beau this guy is Loyal and if he is your Brother or freind you can count on Beau. This article got me thinking I can see some know him and some know nothing about Beau. I hope things work out this is a Sad Situation.

    A double killing that occurs in a public place, involving individuals that identify their membership in an association, is news, like it or not. If it was justifiable, it’s possible that a review of available video and witness statements could result in a quick release, or circumstances can cause a Judge to set a low bail.

    It may be painful to friends and relatives to see inaccuracies in print, but I have the utmost confidence that Rebel does his best to report accurately available information. I also am confident that should verifiable inaccuracies come to light, Rebel will update the story.

    One thing I’ve learned from reading this site for years now is that I can’t even pretend to understand the goings on in a 1% club and usually just try to learn from my elders like Paladin, Sieg, Gandalf and Vago1%er ! I have come to learn that one of the key components to those of you who “live by the code” is fairness and I think in that vein AR deserves to be listened to based on his years of honest, truthful reporting. If he has reported incorrectly he is always the first to amend his writings to reflect the truth ! This story , if common sense is any guide, is far from complete and judgement should at least be delayed, either way, until all of the facts are known ! In the mean time I’ll keep the two men who lost their lives in my thoughts and prayers !

    The problem with Breaking News is that when it “breaks” all the facts may not be known. What was thought to be a duck turns out to be an armadillo. Trouble is, by the time all the facts are sorted out and known, unintentional, irreparable damage may have been done to those involved.

    There are times when a bit of restraint might be in order, especially in a situation like this where all of the facts are obviously still unknown.

From the moment I first contacted him and informed him who the Wicked Souls MC was,what we are and what we’re not, we were greeted with kindness, fairness, respect and understanding which is paramount in our world. He represented himself and his club professionally and has and was nothing but a great guy to me personally, I can’t read this article and see this story, which in my eyes is just a way to slander someone without all the information and facts, I couldn’t read it and not share my personal experience with Beau… With the respect he showed towards our club he personally will forever have my respect and I want to defend his character because of that respect!!!

    Rebel I have always respected your reporting but in this case your reporting is incorrect. I usually stay away from commenting on the internet as it is not the way 1%ers do things . After I read this article I had no choice but to share certain facts that you have mis-represented. Beau is a very respected brother and very loved. He is the only Vago that wears a patch that says SuperVago which clearly states the type of brother he is. Beau is a level-headed person and is always the first to handle things rationally. What happened is really no ones business except our club. You are displaying the same as the general press by mis-representing the facts. I am not going to share the full truth with you regarding what really happened as it is not your business or anyone of your readers business. What I want to correct is that Beau was never arrested in Nevada and is not born in Texas. He is Californian and always has been. The man you are trying to cast shadows on is a great brother and before you try to present otherwise you should acknowledge the fact that you and your readers don’t know him or his character. All of this is a great tragedy for our club. Be respectful please and when reporting please report the truth .
