Happy Anniversary Waco

Today is the anniversary of the notorious “biker brawl” in the parking lot of the Twin Peaks restaurant and time is now running out for the tyrants of Waco. After a long interregnum there is suddenly a flood of legal filings pertinent to the case.

For example James C. Winton, who represents a couple of Twin Peaks customers identified only as “M.K.H.” and “C.R.H.,” served a subpoena on the Waco Police Department custodian of records last Friday at 10:45 a.m. The subpoena also serves notice that Winton intends to depose the custodian of records on June 3 in Dallas.

The list of what Winton is looking is interesting and speaks for itself. It summarizes some of the reasonable questions that the City Of Waco and its officials and McLennan County and its officials have been refusing to address for the last 366 days.

Subpoenaed

1. Writings or Recordings relied on by Waco Police Sergeant W. Patrick Swanton in making the following public statements:

a. “What happened here today could have been avoided . . . They failed and this is what happened.”
b. “This is one of the worst gun fights we’ve ever had in the city limits. They started shooting at our officers.”
c. “None of our innocent civilians were injured today in this melee.”
d. “The management wanted them here.”
e. “Management knew that there were issues, and we were here, but they continued to let these groups of people into their business.”
f. “These are very dangerous, hostile criminal biker gangs.”
g. “Their action has saved lives by keeping this from spilling into a busy Sunday morning.”
h. “The simple answer is we were not welcomed by management here.”
i. “We have been made aware in the last few months of rival biker gangs – rival criminal biker gangs – being here and causing issues. We have attempted to work with the local management of Twin Peaks to get that cut back, to no avail. They have not been of much assistance to us.”
j. Waco Police “described the management as uncooperative with authorities in addressing concerns about gangs.”
k. “Are we frustrated? Sure. Because we feel there may have been more that could have been done by a business to prevent this.”
l. “[P]olice officers were at the sports bar when the fighting began and had secured the area because they ‘knew the chance for violence was significant.’”
m. The fight “began in a restroom before pouring into the restaurant and quickly moving into a patio area and then into the parking lot.”

    Rebel stated in his book (The Twin Peaks Ambush) & possibly in one of these threads that one club involved hired an investigator and that other investigators had been hired by the defense as well.

    If you have not yet purchased Rebels book, you should. It clears much of the fog around what happened before, during & after the ambush.

    What follows is a generalized statement not directed at you David.

    This was a blatant ambush.

    The Cossacks got played by villainous corrupt government & state official’s who are so intent on nailing down a failed investigation they do not care who they have to steam roll over to get what they want. Even before the release of Rebel’s book that was obvious. This thing has smelled like a pile of fish heads since day 1!

    As with many government investigations against targeted organization’s such as MC’s actual criminality is so minimal they (the government) hire actual criminals to commit crimes and place UC’s in place & set people up.

    Back to the Cossacks:

    Watching the video,listening closely to interviews & just by the actions of it’s members a clear pattern of intent appears. There are so many holes you would have to be a complete gullible fool to believe what many of the members (mostly it’s officer’s & key individuals) are floating as truth.

    What they are spewing is lame attempts at justification of actions & covering asses.

    Understand, I have no bone to pick with anyone. But it is a known fact, act like an ass hole, you get treated like an ass hole.

    The Waco brand, which is somewhat synonymous with the Baylor brand, is turning to shit very quickly. University Chancellor fired. Coaches fired. Support staff fired. In the past few minutes yet another star 2016 signee is bailing from the football program. That makes 1/3 of them bailing? That should effectively salt the earth of the new 1/4 billion stadium?

    Bridges collapsing. Yet another dead jail inmate. More biker lawsuits. Can’t get out of that town quick enough.

    AMEN! This was a set up from the beginning. LE incited and enabled the confrontation primarily for publicity. In doing so, they knowingly and intentionally endangered not only the bikers but the staff at the restaurant and other patrons not involved with any MCs.

    Finding cartridge cases on the roof of firebase Don Carlos will confirm the provocation of a gun fight was premeditated and intentional.

    I would like to know how the Hell LE could justify the expectation that their snipers could accurately discriminate between aggressors and victims. While an expert sniper can be expected to hit an intended target, no one could reasonably expect them to identify aggressors during such a chaotic fight. My guess is that the rules of engagement were to target anyone with a gun. However; once the shooting started almost everyone at the scene could reasonably claim that they were in fear for their lives and were justified in arming themselves.

    Only way to fight this is by beating WACO in the legal game. Thorough and specific …. this subpoena seems the start of an actual flow of truth. All the answers we need will be there if this legal maneuver works. Police must be put in the check as well as the good ol boy bully arm of our so called justice system. Seems the public is actually coming around to the smell of something rotten in Waco. Thanks rebel for your work and for bringing light to the truth and FUbar situations we all need to know about. I live in TX, I was supposed to be there last May, a severe hangover kept me home….. so every time I read about this and see my brothers pics on the news I am reminded that it could have been me…. it could have been any of us. Continue the fight against the constant injustice and lies that police and tv talking heads force down our throats.

    it strikes me that there is already a huge miscarriage of justice, 365 days of effectively blocking or restricting vital evidence. The Wacko LE and criminal justice department seem totally inept and there blatant coercion undermines the basis principles of a fair and equitable outcome. This comes as no shock but is more of a sound reminder that the system is designed to protect its own at what ever horrendous cost it takes. In this particular case lives and lost of civil rights is only the tip of iceberg in this escalating show down between bikers and morons with badges….

    I see why this may have taken so long, the defense attorneys were being very thorough. I just worry about fabricated evidence, planted evidence, altered evidence, and of course evidence that just seems to vanish.

    The Waco communist justice system. 74 men, women and children who died in the inferno at Waco on April 19, 1993. Now this. I don’t see any change in site. And for the life of me, I can’t figure out what can be done to have real change.

    So I’m going to just ride on. . . .

    This will be the first of many, many lawsuits that are going to come from this for a variety of Law Enforcement that was involved and has been involved. There are a lot of questions and information being requested and you can bet your ass that Law Enforcement will not want to answer any of it.

    Of course Law Enforcement will take the usual stance of “Their is no substance to this lawsuit and we will not answer any further questions regarding this as it is now before the courts”. They just love to use that line to weasel out of having to answer anything.

    I would be of the opinion that there will be an out of court settlement and of course an NDA accompanying it so they dont lose face and get to avoid answering questions that they would love to have to not answer.

    Fell sorry for the taxpayer, they are going to be in debt for years and years to come from all the lawsuits that arrive out of the mess that Law Enforcement created.

    Watched the CNN take on Waco last night. Waited through most all of it for some nod to the idea that this was if not a set-up, at least encouraged by LE. Got maybe a wink during the 4th quarter. They could have explained to John Q. Public what the COC’s really are. They didn’t. JQP will be left thinking that the COC dues are paid to the Bandidos. There was no mention of what the COC’s actual roll is. Again, JQP will be thinking it’s some kind of criminal conspiracy meeting. For the record: All COC’s are the brainchild of Richard Lester, and attorney for biker’s rights, who started this nationwide phenomenon back in the 80’s. COC meetings were never intended to be a forum for member clubs to work out differences during the meetings. Not to say things didn’t get handled before or after the regular meetings, but intra-club rivalries or differences were not on the regular meeting’s agenda. What WAS talked about was anti-biker legislation, and how to fight that legislation, as well as insurance information, and how to deal with the cops when pulled over. That type of thing. Meetings were always held under Robert’s Rules of order, and the COC’s elected their own chair persons, secretaries, treasurers etc. The only monies collected were the minimum that COC needed to operate, usually $100. per year, per club. Dues did NOT go to the Bandidos, or dominant club in any given area. I would like to have seen/heard that info on the CNN report.
    I DO think that CNN soft-pedaled anything that may have been derogatory towards LE.
    Too bad.
    I hoped for better.

    I think the Twin Peaks franchisor and franchisee already know the answer to some of these questions.

    Remember that within hours of the incident, (likely relying on Swanton’s press releases and to distance the Twin Peaks brand from the franchisee), the franchisor sued the franchisee After the two sides started talking, the case disappeared.

    It is only my opinion, but I surmise the franchisor jumped the gun, over-eager to protect the brand, and after both sides started talking they realized the extent to which neither did anything actually wrong, and that they, and their restaurant and brand, had been punked, and their parking lot and restaurant (and scantily clad waitresses) had been covertly expropriated for the social experiment equivalent purpose of seeing what happens when one introduces a lit match to a barrel of gasoline.

CEO Dewitt did not answer and Special Agent Frost left a message explaining Special Agent Frost had some questions about Twin Peaks Waco upcoming event.” An hour later, “Frost received a phone call from Twin Peaks General Counsel. Special Agent Frost explained the Coalition of Clubs meeting that was expected to take place on 05-17-15 at Twin Peaks and Law Enforcement had concerns about some members of certain motorcycle gangs who may be attending. Special Agent Frosts’ question was if the entire establishment was to be rented out for this meeting. General Counsel explained that the Twin Peaks in Waco was owned by a franchise and that they would make contact with that franchise attorney to make contact with Special Agent Frost.” An hour after that, Waco Twin Peaks owner “Jay Patel called Special Agent Chris Frost and identified himself as the owner of Twin Peaks in Waco. Special Agent Frost explained to Patel that it was DPS CID’S understanding that there was to be a meeting of the Coalition of Clubs on 05-17-15 and asked Patel if the entire Twin Peaks establishment was rented out for this meeting. Patel explained to Special Agent Frost that the Coalition of Clubs had only rented out the patio area of Twin Peaks. Special Agent Frost explained to Patel that there was rising tension between two motorcycle gangs that could possibly both be in attendance at this meeting. Patel explained to Special Agent Frost that Patel was told to expect approximately four hundred (400) bikes and due to this Twin Peaks had hired three security guards. Special Agent Frost advised Patel to call Special Agent Frost if any threats are received or heard of by Twin Peaks.”

    The police started shooting as soon as they BANISHED WEAPONS, not as soon as they fired a weapon. There of causing these people to defend themselves. They had no idea that the person they thought had taken cover was actually shot and killed by the police with silencers.
    THEY NEED TO GET LORENA POLICE CASE FROM DETECTIVE ROGERS. He said that he had the informant from the March 22, 2015 case of the beating of Bandido Rolando Campos and his stolen bike from that day. Yes on March 28th 2015 the PD went to JW thinking that the Bandido’s who stopped at the Flying J truck stop was heading there… THEY WAS GOING TO THE HOSPITAL. Their brother was out of ICU.

    Mr. Winton knows.:) #30 is Important and might show that Waco PD encouraged the Cossacks to attend. Quote “He said Waco police had come to his shop and suggested a “dialogue” between the two clubs.” (Wilson/Waco Trib today). In court at the bail reduction Hearing I believe Mr. Wilson said Waco PD asked them to be at Twin Peaks that morning… add that to the ongoing “War” that LE keeps yapping about + the fact that they didn’t stop it knowing the Cossacks were armed (IC/UCs in Twin Peaks) and the “set up” is proven.

    That’s a LOT of subpoenaed information. Think about how long they will drag their feet in complying, then giving it out piecemeal, passing the buck to other agencies, etc. Already been a year, justice denied, lives ruined (and taken). Mindblowing, absolutely disgraceful.

    Nicely done! The lawyers for Twin Peaks owners should see how this plays out then do the same but with any enhancements indicated by what Winton turns up.

    This could be a template not only for future Waco subpoenas, but for other events not connected with the biker community.
