The context of what happened last Saturday afternoon in Southgate, California when a heavily armed Deputy U.S. Marshall attacked a woman without provocation and destroyed her cell phone is clearer now than it was yesterday when The Aging Rebel first reported the story.
The Mongols and other motorcycle clubs held a fundraiser to help pay for the appeal of Mongols member Christopher Bryan “Stoney”Ablett. Ablett was found guilty in February 2012 of four federal racketeering counts in the murder of Hells Angels Frisco charter president Mark “Papa” Guardado in September 2008. Specifically Ablett was convicted of: 1) Maliciously murdering Guardado “for the purpose of gaining entrance, maintaining his position, or increasing his position within an enterprise (the Mongols Motorcycle Club) engaged in racketeering activity; assaulting Guardado with a deadly weapon “for the purpose of gaining entrance, maintaining his position, or increasing his position within an enterprise engaged in racketeering activity;” knowingly using “a firearm during and in relation to, the crimes charged in” the previous counts; and using a firearm “during and in relation to the murder in aid of racketeering of Mark Guardado, as charged in” the first two counts “and that the firearm was used to cause the death of Mark Guardado.”
Ablett was sentenced to life in prison without possibility of parole and a legal defense fund, separate and unrelated to the Mongols, was established by Ablett’s friends and relatives about six months ago. The defense fund has a website here.
News accounts of the Marshall’s assault published by NBC, the Huffington Post, the Los Angeles Times and London’s Daily Mirror all reported that a “multi-agency task force” had raided a Mongols “meeting.” “NBC News Investigative Unit” reported that the woman victimized by the Marshall was recording “a confrontation…involving members of the outlaw biker gang notorious for violent crimes called the Mongols.” Those news accounts were inaccurate and misleading.
There was no club meeting. The event was a peaceful assembly of American citizens engaged in a lawful activity on private property. The police were there to censor and harass that lawful activity in violation of the First Amendment to the Constitution which states: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”
There was no “confrontation.” The police harassment was not connected to any search or arrest warrants. The sole point of the action was to harass participants in a legal fundraiser intended to petition the government for a redress of what participants consider to be a legitimate grievance. Police never actually entered the property where the fundraiser was held.
The multi-agency taskforce also violated the Fourth Amendment which states: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” Every person on the public street in front of the legal fundraiser was stopped, harassed, photographed and compelled under color of legal authority to fill out a “gang card.”
Police have not announced how many people were “arrested.” As a result of illegally detaining every person who ventured onto the public street, an unknown number of people were arrested for unresolved traffic tickets.
The Aging Rebel has confirmed that virtually everyone who was harassed was told that the harassment was punishment for associating with the Mongols. A commenter to this page reported that he was detained by ten policemen without justification and told, “Just so you know. we’re gonna be here all day pulling you guys over.”
The woman who was assaulted by a heavily armed government agent was assaulted to prevent her from documenting the illegal harassment – not because she was affiliated with the Mongols in anyway but to prevent her from exposing the illegal conduct of the police.
The name of the Marshall in the video below as well the names of those who planned, supervised and executed the illegal action last Saturday are being intentionally concealed from public scrutiny.
