The Longest Trial

The sputtering trial of three Hells Angels named Timothy R. Bianchi, Nicholas F. Carrillo and Josh L. Johnson in Lake County, California is starting to look like a permanent institution.

The three men are accused of seriously beating a Vago named Michael Anthony Burns at an Indian Casino called Konocti Vista in Lakeport, California in June 2011. Burns insists he suffered the injuries to his face and head during a fall. The Lake County Sheriff, a zealot named Francisco Rivero (photo above), refused to believe Burns and instead saw a way to attack what he regards as the great and terrible threat posed by outlaw motorcycle clubs.

Saving Lakeport

The fight came just a month after Rivero somehow convinced himself that a pack of 150 Hells Angels was on its way to attack a party of fifty or so Vagos. Shaken by what he imagined, Rivero ordered every cop in Lake County to proceed “Code Three” to a town called Middleton, thirty miles south of Lakeport, where the assembled forces of good would meet the invading army of Hells Angels and stop them as Charles Martel stopped the Moors at the Battle of Tours. “Code Three” is cop-phonics for what police do when they turn on their lights and sirens and see how fast their cars can go.

Rivero ordered Highway 29, which is the only road in and out of Lakeport, closed. That day, three cruisers narrowly avoided a Smokey and the Bandit moment at the intersection of Highways 29 and 175. The 175 is the twisting mountain road that connects Highway 29 to the 101 Freeway and the dangerous outside world – to Healdsburg and Astoria and eventually godless places like San Francisco, Seattle and Los Angeles. Snipers were deployed. Eventually, after a tense couple of hours, it turned out the Hells Angels were all spirits and had melted into air, into thin air.

And then three of them reappeared at the Konocti Indian Casino!

Still Saving Lakeport

The tale of the vanishing Hells Angels of 2011 was retold at Bianchi, Carrillo and Johnson’s trial last week. A Lakeport Police Department Lieutenant named Jason Ferguson was there the day the massive pack of Angels disappeared. And the day Burns was beaten Ferguson saw another group of 50 bikers. He is pretty sure some of them were Angels and he heard the ones that were Angels yell something at Burns as Burns rode by. “I didn’t hear the specific verbiage, but my opinion was it was not positive. It was negative,” Ferguson told jurors last week.

Most of the rest of the trial so far this month has been dedicated to establishing that the defendants are Hells Angels and although technically it is not illegal to be a Hells Angel it should be. A prosecutor named Art Grothe showed the jury a sign found in one of the defendants’ homes that read, “The meek shall inherit the earth when we’re through with it. Hells Angels World.” Grothe then entered a copy of the sign into evidence and then he displayed it at the front of the courtroom for most of a day. Then the trial recessed.

Soon an “Outlaw Motorcycle Gang and Expert Testimony Instructor” named Jorge Gil-Blanco will testify for a week. He is expected to say over and over again that it should be illegal to be a Hells Angel. There is as yet no estimate of how long this trial will continue or what it has cost so far or how much it will eventually cost or when, if ever, it might end.

    After watching sheriff riveros veterans status tape its apparant he has no problem lieing . That should be enough to impeach any testimony he gives in court. The merchant marine by definition are not military or part of the coast guard. He is not a veteran unless he means veteran of the bullshit wars.

    The United States Merchant Marine is the fleet of U.S. civilian-owned merchant vessels. The Merchant Marine Academy is not funded by the DoD. It’s funded by the US Department of Transportation and is administered by the U.S. Maritime Administration.

    In time of war, the Merchant Marine is capable of being an auxiliary to the Navy, but does not have a role in combat, nor is it part of the Military Sealift Command.

    The question the listeners should have asked the Sheriff is; “Based on your prior service with the Merchant Marines, do you receive benefits from the Veteran’s Administration?” The obvious answer would be no.

    Sheriff Rivero is not a Military Veteran. However; to be fair, Sheriff Rivero is a liar and a disgrace to the uniform he wears and a disgrace to any uniform that he may have worn in the past.

    Watched the video about his veteran status. It needs to be done over with an officer from the Merchant Marines attending in person. I grew up next door to a retired Merchant Marine. Just from knowing him, I’d bet the sheriff’s veteran stautus would be straightened out plainly and quickly.

    Just thought, has anyone ever verified his service in the Merchant Marine? Not that he’s a liar or anything…

    The defendants lawyer only needs to show the jury the lieing stolen valor tape to discount his entire testimony. Remember what OJ’s lawyer did to the cop who swore he never said nigger? Everything he said from then on was suspect.

    I had, they’ve all since passed away, relatives who served in the Merchant Marines in past conflicts. It is an honorable way to serve both during peace and war time. They were not military although they faced lots of the same dangers at sea as the Navy did, supply and support vessels sink when hit just as quickly as combat vessels do.
    As to this story, if the Vago club member says he fell then where’s the crime ? This is a classic example of over reaching jurisdiction and is total bullshit.

    When the Merchant Marines start going through Basic Training, then I’ll maybe consider giving them the same respect as Real Veterans. No disrespect to Merchant Marines especially the ones who served on ships during War time! It’s a respectable career, but you are not Veterans of the Military. This Sheriff, like all Pigs is a joke.
    Want to be a Military Veteran? Go to your nearest recruiting station and sign up! Simple as that.

    Oh my….. Look I am not trying to crap on the Merchant Marines here, but when they go around parading like the were in the Marine Corps it warrants a chop to the throat…. Just my personal opinion. You know, it humanely shocks their system and gets them to stop talking all in one movement.

    My Great Uncle was ship’s captain in the UK’s Merchant Marines during the days of Chaing Kai-shek. Lost all his teeth fighting off pirates trying to overrun his ship one night on the Yangtze River. He saw a lot of fighting during his days of service. I remember him telling me stories of those times. He WAS a true bad-ass.

    Stolen valor is the lowest form of cowardice. Shame, shame on you Sherrif Francisco Rivera.

    What is the official charge? It cannot be assault if there is no plaintiff. Just like in a domestic violence case, someone has to press charges- the state cannot do it. So, the charges have to be something “gang” or “lynching” way a simple assault charge sees the light of day in this case. Any judge who allows it is a moron in my opinion.

    Considering the US Merchant Marine Fleet suffered some of the greatest causalities of any branch of service during WW2 I think they earned the right to hold their heads as high and proud as anyone…..
    Stolen valor is unforgivable offense and deserves an ass whipping and this cop is a douce bag.

    Sheriff Rivero is as an elected sheriff a politician, politicians are by definition prolific liars, therefore Sheriff Rivero is a prolific liar.

    This trial is a joke, some deputy sees a member of a M/C ride by a group of bikers, and words are exchanged, he doesn’t know what is said, but he thinks it wasn’t friendly. Some time later a member of an M/C has some injuries, he says he got them in a fall, but the Sheriffs Dept with out any other apparent evidence decides that there was a fight and lay’s charges based not on any reasonable probable cause, but the sole fact that iit gave them the oppertunity to fuck with two clubs.

    Respect to both clubs for keeping the code.

    I forgot to add to the above, does anybody really believe that if anyone else was accused of a fist fight in the lobby and the only evidence they had was some spliced up video that they would have ever been charged??

    7 club brothers in Vegas were arrest last year for a fight, some guy in one group kept flapping his gums at some club brothers, finally the oldest brother present drops him with one punch and the cops go crazy with gang enhancements and felony charges. Hell you can’t even calll that a fist fight, one punch and out!!

    Not to put too fine a point on it, but there is video from the security cameras that show the alleged altercation. The video doesn’t excuse this small time sheriff’s behavior, but the video is what the prosecution’s case is built on. The prosecution still has to prove that the alleged victim’s injuries were the result of hands being laid on by others. If the alleged victim testifies on behalf of the defense, the prosecution may have a hard time selling their car.

    Hopefully; the members of the jury will be so pissed over the fact that they were summoned to court over such a bullshit case, that they’ll let the court know of their displeasure by returning a verdict of not guilty, by reason of prosecutorial stupidity.
