Charges Dismissed Against Rockford Angels

The Winnebago County State’s Attorney’s Office dismissed charges of armed robbery, aggravated kidnapping of a child younger than 13, unlawful possession of a stolen vehicle, aggravated battery with a Taser, aggravated battery with a knife, aggravated battery with an ax handle and mob action against seven members of the Rockford charter of the Hells Angels Motorcycle Club last week.

Charges were dropped against Richard Todd, Robert Bell, John Savalick, Dariusz Achramowicz, Tomas Lech, Jose Velma and Christopher Lawson. The men had been scheduled to stand trial starting today. Prosecutors dismissed the charges after a judge named Joe McGraw refused to delay the start of the trial so prosecutors could strengthen their case against the seven.

Deputy State’s Attorney Jim Brun told television station WIFR that the alleged victim in the case had refused to testify against the accused and implied that he had been intimidated. “As I indicated, the State’s Attorney’s responsibility is to provide a fair trial to all, so we’re certainly not going to rush a case to trail just to say everyone has their right to due process and everyone has their right to a fair trial and part of that is to protect our, all our witnesses so that is part of our decision making process that we deployed at this time,” Brun said.

The Sixth Amendment to the Constitution provides that: “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.”

Three other defendants did begin trial today. Those men are Aloysius Balice, Dennis R. Juno and Donald J. Hess. Four defendants named Bradley Wilhelm, Earl Murray, Curt Lambert and Neal Resendez pled guilty to lesser charges last week.

The Case

Prosecutors brought the charges against fourteen defendants in July 2013.

The state alleged that on June 27, 2013 the defendants confined an unnamed Rockford man to the charter club house, hit him with an ax handle, punched him, struck him with brass knuckles and a hammer, Tasered him and stabbed him. Police claimed the men cooperated to steal the victim’s wallet, keys and truck and that they detained an 11-year-old girl while the victim was assaulted. There are no allegations that the child was harmed. The investigation started after the victim went to a hospital for treatment and a motive has never been specified. A usually informed source, speaking anonymously, identified the victim as a former charter officer who had been accused of stealing from the club.

At the time of the arrests, police also raided the clubhouse at 1109 Rock St. in Rockford, searched it and then condemned the building.

Rockford City Attorney Jennifer Cacciapaglia told the Rockford Register Star that the clubhouse chimney and plumbing were falling apart, that wiring was exposed, and that the building lacked smoke detectors and a fire escape. “It’s going to be a pretty extensive list,” Cacciapaglia told the paper. “There’s a portion of the roof that is in significant disrepair. I don’t know how soon they’ll be able to address each item.”

Although condemned, the clubhouse is still owned by the club and is currently listed for sale for $59,000.

    Isn’t it rather odd that a Motorcycle Club that the Government claims is a multi-national criminal enterprise worth billions of dollars cannot afford to repair a Club House which would cost only $60,000.00 and thus has had to sell the property for the cost of the repairs? Around these parts folks would say “That dog don’t hunt”.

    Congratulations nonetheless to the Charter on the dismissal of the charges brought against them and here’s hoping they can raise the funds to repair their their Club House or find another that better suits their needs.

    It would be interesting to know how much tax payer money was wasted trying to lynch this group of men who obviously have done no wrong. Surely the good citizens who have had to pay for this fishing expedition are entitled to know the extent to which they have been fleeced.

    I don’t think that celebration is in order. Odds are that the government’s shitty case isn’t going to get any better with time – but it could. I’d be much happier if the shitty case formally fell apart after the jury was seated and sworn at this last trial date. Now there is every chance that this DA will re-indict, set a new bond and start the whole process over again. It is possible, if not likely, that any commercial bail-bondsman will consider his obligation met and insist on a new arrangement to go with the new indictment. It’s a little fucked.

    dear nashville; thanks for the cold water. i am going to have a little celebration despite your admonition against it. Your suggested strategy, which i believe is basically “dont take the victory: risk it against a jury full of idiots instead down the road and remain in danger while you wait and hope that the jury is sane” is not very sensible if you have ever been a party to the imbecility of jury selection where only the most idiotic and malleable are chosen based upon their inability to hold a conviction of any kind other than the conviction that jury duty is “really exciting and makes me a part of the democratic process.” i am sure they did the right thing. anticipating the moves of anyone in government is never really very smart and if they tell you “you may go home now,” go home and wait for the next assault because since its going to come – to us all eventually – it might as well be in a saloon that your waiting in with no further court appearances pending rather than in a saloon with a court appearance pending.

    Regardless of any clubs financial ability, it makes little sense to spend much on a clubhouse when the alphabet soup LEO’s can and will on a whim enter, destroy, pillage and seize your property.
    I have been in lots of CH’s across the country. Utilitarian seems to be the style that is favored these days.

    The real issue with the club house was the zoning of it. Their next house will have to be in a residential area instead of being right downtown in a business zone.

    Another point of interest is the wall with the death’s head painted on it. The realtor claims it goes with the sale. Yeah, we’ll see about that.

    It’s also kinda trip that there is a 1% Club here in Kansas that has a CH
    in the downtown section. Not a small city either. Been there for years.
    Also a non 1% Club in a smaller town right on main street. Guess Kansas
    politicians don’t have hard-ons for the wrong groups.

    WARTHOG, don’t guess this is anything that isn’t known, but the CH was inherited from a club that patched-over to the Angels some years back. The “business district” it’s in is on the fringe of the ghetto-used to be the heart of the ghetto. Place has been pretty well beat for many moons.

    Bet the most expensive part of rehabbing it will be getting all the bugs out.

    Funny nobody blinks an eye at the crack house the feds set up shop in when the Angels held their chili cook off. Also strange there was an inspection after this incident dispite the fact they’ve been there 20 years. Doubt it had anything to do with the annual run being in Rockford that year. Fuck em.

    The problem is that even when you win you lose, the Fed/Pigs lose nothing by bringing bogus charges, they aren’t spending their money, they are spending ours, and they have the added benefit of making the club and it’s members dig deep to defend themselves no matter how weak the case or bogus the charges, they pay no price, we pay a deep one. The Long game for the feds and pigs is too keep the charges coming until everyone is too broke to fight anymore.

    If the judges had the same sense with Pagan White Bear 1% might still be around, for not all the stress and the bullshit that comes from being on paper.

    Congratulations to the victims of persecution and mis-prosecution. It is a shame, but here in America these days, we cheer for the innocent to be found not guilty. So many mis-prosecutions these days. In each, the prosecutor ignores his legal responsibilities to pile on with the LEO. I have not seen any of the biker mis-prosecutors being punished for violating their duty.

    We need more wrongful prosecution claims. However, it is hard to do so when someone is forced to plead guilty. That’s one reason the prosecutors force a guilty plea from someone in each case.

    Now, club officers have to worry about zoning and health inspections as well as RICO and provocateurs. It would be worthwhile for clubs to look up the status and requirements. Next we’ll be getting busted for allowing cigarette smoking in the buildings! I don’t doubt that it will show up in an indictment sooner or later…WTF?

    No MC can set up a clubhouse near me. There’s regulations against it, laws on zoning, and then the HOA is a real council of dicks.

    There’s a guy down the street from me who has regular get-togethers with his biker buddies. I don’t know if they are an actual 3p club, but they have 3 pieces and a rocker. It’s not the same thing though…

    Anyway, they just get together and play poker and listen to music at his place. I’ve never heard the music too loud and there’s never been any problems, but the HOA is up in arms and using legal means to stop it.

    Respect works both ways. If you’re loud and obnoxious and try to bully your way around, don’t think you’re a man. You’re a coward, a bully, and you need to be eliminated from society for the betterment of the human race. If you’re cooperative, courteous, and willing to be respectful to those around you, you go far and find yourself with more supporters than enemies.

    You’d think people would get this by now.

    This is the fallback position the State will always take when their prosecutors are unable to stack the deck against the Defendant.

    Usually when an MC open up a new clubhouse in a neighborhood the crime goes down and the neighbors appreciate having them there. These are for the most part not the nicest neighborhoods in the first place

    As stated in an earlier post, that CH is pretty much in the ghetto. WARTHOG is right, it had passed an inspection not long ago, and it has been there, that I know of, for at least 30 years. I never heard of a hassle there in all that time. There are multiple dope houses within a few blocks of it that somehow seem to stay open.

    Whole thing is strictly about the Rockford piggies trying to get some licks in, and being backed-up by local politicos.

    Should be noted that Rockford is totally fucked. Used to have all kinds of industry and good jobs, but that’s pretty much down the road. High unemployment, high crime rate, mucho ghetto, a school system so bad the feds took it over, the list goes on.

    Historically, there have been at least 4 clubs in and around Rockford for decades. There have been some skirmishes, and yeah, one or two major hits, but for the most part, it was all good.

    Noise I’ve heard is that it’s getting to the point that it’s more hassle than it’s worth for a club to stay there…time will tell.
